MOTOR VEHICLE AMENDMENT ACT, 1997

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the

Province of British Columbia, enacts as follows:

Section 100 (2) of the Motor Vehicle Act, R.S.B.C. 1996, c. 318, is amended by striking

out "$300" and substituting "$500" .

Section 122 (2) and (3) is repealed and the following substituted:

(2) The driver of an emergency vehicle must not exercise the privileges granted by

subsection (1) except in accordance with the regulations.

Section 210 (3) is amended by adding the following paragraph:

(

q) respecting the circumstances in which and the conditions on which a driver

of an emergency vehicle may exercise the privileges granted by

section 122 (1).

Commencement

4 Sections 1 to 3 of this Act come into force by regulation of the Lieutenant Governor

in Council.

Explanatory Notes

[This Bill amends the Revised Statutes of British Columbia,

1996. The Revised Statutes of British Columbia, 1996 came into force on April

21, 1997.]

SECTION 1: [Motor Vehicle Act, amends

section 100 (2)] increases from $300 to $500 the

fine amount payable by a driver of a motor vehicle who, as a result of refusing

to stop when required by a peace officer, causes the peace officer to pursue that

driver.

SECTION 2: [Motor Vehicle Act, amends

section 122] restricts the circumstances in which

a driver of an emergency vehicle may disregard traffic rules and control

devices to those circumstances prescribed by the Lieutenant Governor in

Council.

SECTION 3: [Motor Vehicle Act, adds

section 210 (3) (q)] permits the Lieutenant Governor

in Council to make regulations to establish the circumstances in which and the

conditions on which a driver of an emergency vehicle may disregard traffic

rules and control devices.
