Off-highway Vehicles Equipment Regulations

made under subsection 37(1) of the

Road Trails Act

Citation

1 These regulations may be cited as the Off-highway Vehicles Equipment Regulations .

Equipment in good working order

2 Safety equipment on an off-highway vehicle installed by the manufacturer must be

maintained in good working order.

Headlamps

(1) A person must not operate an off-highway vehicle on a road trail unless the light

from its headlamps meets all of the following requirements:

(

a) it is white and the lens and bulb of the headlamp is made of clear untinted

glazing;

(

b) it is of sufficient intensity to reveal a person, another vehicle or an object

that is at least 150 m ahead;

(

c) it is aimed so that, on a straight and level surface, the high intensity portion

of the beam does not shine in the eyes of an approaching driver.

(2) A person must not attach or apply anything to a headlamp, a part of a headlamp or

the bulb of a headlamp that colours the light from the headlamp.

Tail lamps

4 A person must not operate an off-highway vehicle on a road trail unless it has a tail lamp

that meets all of the following requirements:

(

a) at least 1 tail lamp is mounted to the rear of the vehicle;

(

b) the tail lamp is capable of emitting a red light that is visible from at least

150 m to the rear of the vehicle;

(

c) the tail lamp is red.

Side mirror

5 A side mirror must be affixed in a manner that provides a clear view of the roadway

behind and to the side of the vehicle so that an approaching vehicle is clearly visible to

the driver of the off-highway vehicle.

Brake system

6 A person must not operate an off-highway vehicle on a road trail unless the off-highway

vehicle is equipped with a brake system that is sufficiently powerful to stop the vehicle

quickly in case of an emergency and hold the vehicle stationary.

Helmets

7 A person operating an off-highway vehicle must wear a helmet that bears a mark

indicating that the helmet is approved or certified as a helmet for the appropriate class of

off-highway vehicle by 1 or more of the following certification agencies:

(

a) the British Standards Institute;

(

b) the Snell Memorial Foundation;

(

c) the U.S. Department of Transportation;

(

d) the Economic Commission for Europe.

Offences and penalties

(1) A person who violates subsection 3(1) or (2) or

Section 4 is guilty of an offence

and liable on

summary conviction to the penalties provided for a category A

offence in the

Summary Proceedings Act .

(2) A person who violates

Section 5 or 6 is guilty of an offence and liable on

summary

conviction to the penalties provided for a category C offence in the

Summary

Proceedings Act .

(3) A person who violates

Section 7 is guilty of an offence and liable on

summary

conviction to the penalties provided for a category F offence in the

Summary

Proceedings Act .
