B.C. Reg. 9/2010 , deposited January 14, 2010, pursuant to the MOTOR VEHICLE ACT [Section 210 (2), (3) and (9)]. Order in Council 022/2010, approved and ordered January 14, 2010.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the Motor Vehicle Act Regulations, B.C. Reg. 26/58, are amended as set out in the attached Schedule.

Schedule

Section 10.02 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is repealed and the following substituted:

Application

10.02 This Division applies only to a business vehicle or a commercial passenger vehicle for which a licence or temporary operating permit under the Passenger Transportation Act is required.

Section 10.03 (1) is amended by striking out " permit, under the Passenger Transportation Act or the Motor Carrier Act , " and substituting " permit under the Passenger Transportation Act ".

Section 10.08 (3) (

b) is amended by striking out " by licence or permit under the Motor Carrier Act or ".

Section 39.03 is amended by adding the following subsection:

(1.1) Despite sections 39.01, 39.02 and 39.021, a person May stand while a bus is being operated and a driver May operate a bus in which a person is standing if both of the following conditions are met:

(

a) the bus is

(

i) operated by or on behalf of

(

A) British Columbia Transit under the British Columbia Transit Act , or

(

B) the South Coast British Columbia Transportation Authority under the South Coast British Columbia Transportation Authority Act , or

(ii) operated by or on behalf of a person, municipality or treaty first nation as part of an independent transit service approved by the South Coast British Columbia Transportation Authority under

section 5 of the South Coast British Columbia Transportation Authority Act ;

(

b) the number of passengers standing does not exceed the lesser of

(

i) the number determined by applying the calculations set out in

section 10.03 (2) and (3), and

(ii) the number of handholds, straps, rails or other pieces of equipment available in the bus to provide support for standing passengers.
