Loi sur les fondations pour les études supérieures Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 7 of the Higher Education Foundation Act,

chapter H-4.1 of the Acts of New Brunswick, 1992, is amended 1 L’article 7 de la

chapitre H-4.1 des Lois du Nouveau- Brunswick de 1992, est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 7(1) A foundation consists of a board of five trustees constituted as follows: 7(1) Une fondation est constituée d’un conseil de cinq fiduciaires répartis selon ce qui suit : (

a) three trustees appointed by the Lieutenant- Governor in Council, whose names have been recom- mended by the institution; and

a) trois fiduciaires, dont les noms ont été recomman- dés par l’établissement, sont nommés par le lieutenant-gouverneur en conseil; (

b) two trustees appointed by the Lieutenant- Governor in Council.

Section 12 of the Act is amended by adding after subsection (4) the following: 2 L’article 12 de la Loi est modifié par l’adjonction après le paragraphe (4) de ce qui suit : 12(5) A foundation is not required to have an audit con- ducted if the foundation, for the fiscal year in question, did not hold any real or personal property, including money. 12(5) Une fondation n’est pas tenue de faire l’objet d’une vérification comptable si, pour l’exercice financier en question, elle ne détenait aucun bien personnel ou réel, y compris de l’argent. 3

Section 14 of the Act is amended by adding after subsection (1) the following: 3 L’article 14 de la Loi est modifié par l’adjonction après le paragraphe (1) de ce qui suit : 14(1.1) Where a foundation did not hold any real or per- sonal property, including money, in a given fiscal year, its annual report shall consist of a letter to the Minister con- firming that it did not hold any such property, and de- scribing what, if any, activities it undertook during the year in question. 14(1.1) Si la fondation ne détenait ni bien réel ni bien personnel, y compris de l’argent pendant un exercice fi- nancier donné, une lettre adressée au Ministre lui confir- mant ce fait et décrivant quelles ont été ses activités pendant cet exercice, le cas échéant, fait office de rapport annuel. 4

Schedule B of the Act is amended by striking out “New Brunswick Community College” and substituting “New Brunswick Community College/Collège commu- nautaire du Nouveau-Brunswick”. 4 L’Annexe B de la Loi est modifiée par la suppression de « Collège communautaire du Nouveau-Brunswick » et son remplacement par « Collège communautaire du Nouveau-Brunswick/New Brunswick Community Col- lege ». 5

Schedule C of the Act is amended 5 L’Annexe C de la Loi est modifiée (

a) by striking out the following:

a) The existing provision is as follows:

c) The existing provision is as follows:
