B.C. Reg. 123/2003, deposited March 28, 2003, pursuant to the FOREST ACT [Sections 151 and 151.1], the RANGE ACT [Section 44] and the FOREST PRACTICES CODE OF BRITISH COLUMBIA ACT [Sections 198, 208 and 217.1]. Order in Council 301/2003, approved and ordered March 28, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective April 1, 2003

(

a) the Forest Regions and Districts Regulation, B.C. Reg. 19/2000, is repealed and the Forest Regions and Districts Regulation in

Schedule 1 attached to this order is substituted,

(

b) the Operational and Site Planning Regulation, B.C. Reg. 107/98, is amended as set out in

Schedule 2 attached to this order,

(

c) the Timber Harvesting Contract and Subcontract Regulation, B.C. Reg. 22/96, is amended as set out in

Schedule 3 attached to this order,

(

d) the Woodlot Licence Forest Management Regulation, B.C. Reg. 325/98, is amended as set in

Schedule 4 attached to this order,

(

e) the Range Regulation, B.C. Reg. 199/2000, is amended as set out in

Schedule 5 attached to this order and the boundaries of the range districts in the attached

Schedule 1

FOREST REGIONS AND DISTRICTS REGULATION

Forest regions established

(1) The Coast forest region is established as shown on the attached map titled, "Coast forest region".

(2) The Northern Interior forest region is established as shown on the attached map titled, "Northern Interior forest region".

(3) The Southern Interior forest region is established as shown on the attached map titled, "Southern Interior forest region".

Forest districts established

(1) The following forest districts are established as shown on the attached map titled "Coast forest region": Campbell River forest district; Chilliwack forest district; North Coast forest district; North Island-Central Coast forest district; Queen Charlotte Islands forest district; South Island forest district; Squamish forest district; Sunshine Coast forest district.

(2) The following forest districts are established as shown on the attached map titled "Northern Interior forest region": Fort Nelson forest district; Fort St. James forest district; Kalum forest district; Mackenzie forest district; Nadina forest district; Peace forest district; Prince George forest district; Skeena Stikine forest district, Vanderhoof forest district.

(3) The following forest districts are established as shown on the attached map titled "Southern Interior forest region": Arrow Boundary forest district; Cascades forest district; Central Cariboo forest district; Chilcotin forest district; Columbia forest district; Headwaters forest district; Kamloops forest district; Kootenay Lake forest district; Okanagan Shuswap forest district; Quesnel forest district; Rocky Mountain forest district; 100 Mile House forest district.

Pursuant to

section 6 of the Regulations Act , I hereby exempt from publication the sketches attached to B.C. Reg. 123/2003.

Schedule 2

Section 1 of the Operational and Site Planning Regulation, B.C. Reg. 107/98, is amended

(

a) by repealing the definition of "Coast" and substituting the following:

"Coast" means that geographic area contained in

(

a) the Coast forest region, and

(

b) the Kalum forest district in the Northern Interior forest region; ,

(

b) by repealing the

definitions of "Cariboo forest region", "Kamloops forest region", "Nelson forest region", "Prince George forest region", "Prince Rupert forest region" and "Vancouver forest region" and substituting the following:

"Coast Forest Region" has the same meaning as in the Forest Regions and Districts Regulation;

"Northern Interior Forest Region" has the same meaning as in the Forest Regions and Districts Regulation;

"Southern Interior Forest Region" has the same meaning as in the Forest Regions and Districts Regulation; .

Section 11 is amended by repealing subsection (1) and substituting the following:

(1) The maximum size of a cutblock must not exceed

(a) 40 ha for the following areas:

(

i) Coast forest region;

(ii) the following portions of the Southern Interior forest region:

(

A) Arrow Boundary forest district;

(

B) Cascades forest district;

(

C) Columbia forest district;

(

D) Headwaters forest district, except that portion of the district that is in the Robson Valley timber supply area;

(

E) Kamloops forest district;

(

F) Kootenay Lake forest district;

(

G) Okanagan Shuswap forest district;

(

H) Rocky Mountain forest district, and

(b) 60 ha for the following areas:

(

i) Northern Interior forest region;

(ii) the following portions of the Southern Interior forest region:

(A) 100 Mile House forest district;

(

B) Central Cariboo forest district;

(

C) Chilcotin forest district;

(

D) that portion of the Headwaters forest district that is in the Robson Valley timber supply area;

(

E) Quesnel forest district.

Schedule 3

1 The Timber Harvesting Contract and Subcontract Regulation, B.C. Reg. 22/96, is amended by repealing the definition of "coastal area" and substituting the following:

"coastal area" means the area within one or more timber supply areas or tree farm licences listed below:

"Coast" means that geographic area contained in

(

a) the Coast forest region, and

(

b) the Kalum forest district in the Northern Interior forest region; .

Schedule 5

1 The Range Regulation, B.C. Reg. 199/2000, is amended by repealing

section 13 and substituting the following:

Range districts

(1) The Coast range district has the same boundary as the Coast forest region under the Forest Regions and Districts Regulation.

(2) The Northern Interior range district has the same boundary as the Northern Interior forest region under the Forest Regions and Districts Regulation.

(3) The Southern Interior range district has the same boundary as the Southern Interior forest region under the Forest Regions and Districts Regulation.
