Bill 31 BILL 31 1981 THE PENSION STATUTES AMENDMENT ACT, 1981 (Assented to , 1981) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: The Public Service Pension Act 1(1) The Public Service Pension Act is amended by this section.

(2) Section 40 is amended by adding the following after clause (a): (a.1) the rate of employer contributions required under

section 5.1, The Universities Academic Pension Act 2(1) The Universities Academic Pension Act is amended by this section.

(2) section 38 is repealed and the following is substituted: 1

Explanatory Notes The Public Service Pension Act 1(1) This

section will amend

chapter 299 of the Revised Statutes of Alberta 1970.

(2) Section 40 presently reads: 40 If the employees to whom this Part applies become participants under the Canada Pension Plan, the Lieutenant Governor in Council may by regulation alter (

a) the rate of employee contributions required under

section 5, (

b) the service to be recognized as pensionable service and the required payments under

section 14, and (

c) the amounts of the pension payable under sections 16 to 21, in respect of any periods of service during which the employees are participants under the Canada Pension Plan and in conformity with any agreement made between the Governments of Canada and Alberta, and such regulation shall be of the same force and effect as if it were enacted as part of this Act. The Universities Academic Pension Act 2(1) This

section will amend

chapter 36 of the Statutes of Alberta, 1978.

(2) Section 38 presently reads: 38 Notwithstanding

section 13(1)(f), if members who are in the employ of a University on July 1, 1978 have made either payment in full or a pay assignment within 24 months from that date to cover any period or periods of service, the provisions of

section 15(1) and (2) of The Public Service Management Pension Act as they stood immediately before Jan uary 1, 1978 apply to those members with all necessary modifications. 1

38 Notwithstanding

section 13(1)(f), in the case of a member who (

a) is in the employ of a University on July 1, 1978, (

b) has made a written request to the Board on or before June 30, 1980 to be advised of the amount required to es tablish any period or periods of service as pensionable service, and (

c) has made arrangements for payment satisfactory to the Board by June 30, 1980 with respect to that service or within 90 days of being advised of the cost by the Board, whichever is later, the amount to be paid to the Provincial Treasurer shall be de termined in accordance with the contributory provisions appli cable under

section 15(1) and (2) of The Public Service Management Pension Act as it read immediately before January 1, 1978, with any modifications that the Board considers necessary. In accordance with

section 4(1) of The

Interpretation Act, 1980, this Bill comes into force on the date it re ceives Royal Assent. 2 Title: 1981 (19th, 3rd) Bill 31, The Pension Statutes Amendment Act, 1981
