B.C. Reg. 184/2024 , deposited July 8, 2024, under the ANIMAL HEALTH ACT [sections 96 (3) and 98], EMERGENCY AND DISASTER MANAGEMENT ACT [sections 163 and 173], INTEGRATED PEST MANAGEMENT ACT [section 37],

INTERPRETATION ACT [section 27 (4)], POLICE ACT [section 74], STRATA PROPERTY ACT [section 292 (2)], and WATER SUSTAINABILITY ACT [section 127 (3)]. Order in Council 436/2024, approved and ordered July 6, 2024.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders the following:

(

a) the regulations listed in

Schedule 1 are repealed as set out in that Schedule;

(

b) the regulations listed in

Schedule 2 are amended as set out in that Schedule.

Schedule 1

1 The following regulations are repealed:

(

a) the Emergency Program Management Regulation, B.C. Reg. 477/94;

(

b) the Local Authority Emergency Management Regulation, B.C. Reg. 380/95;

(

c) the Milk Industry Standards Exception Regulation, B.C. Reg. 1/2022;

(

d) the Pesticide Control Act Regulation, B.C. Reg. 319/81.

Schedule 2

Organized Crime Agency of British Columbia Operations Regulation

Section 7 of the Organized Crime Agency of British Columbia Operations Regulation, B.C. Reg. 229/2002, is repealed.

Premises Identification Regulation

Section 10 (

b) of the Premises Identification Regulation, B.C. Reg. 125/2022, is repealed and the following substituted:

(

b) for the purposes of mitigating, preparing for, responding to or recovering from an emergency as defined in the Emergency and Disaster Management Act ,

(

i) to the minister responsible for the administration of that Act,

(ii) to the provincial administrator under that Act, or

(iii) to a lead minister or local authority as defined in that Act.

Section 11 (1) is amended by repealing the definition of "affected area" and substituting the following:

"affected area" means the following:

(

a) an area to which a declaration of a state of local emergency, as defined in

section 175 of the Emergency and Disaster Management Act , applies;

(

b) an area to which a declaration of a state of provincial emergency or a declaration of a state of local emergency, made under the Emergency and Disaster Management Act , applies; .

South Coast British Columbia Transportation Authority

Police Service Operations Regulation

Section 3 of the South Coast British Columbia Transportation Authority Police Service Operations Regulation, B.C. Reg. 484/2004, is repealed.

Stl’atl’imx Tribal Police Service Operations Regulation

Section 4 of the Stl’atl’imx Tribal Police Service Operations Regulation, B.C. Reg. 385/99, is repealed.

Strata Property Regulation

Section 17.23 of the Strata Property Regulation, B.C. Reg. 43/2000, is amended

(

a) by repealing subsection (1),

(

b) in subsection (2) by striking out " a declaration of a state of emergency or a declaration of a state of local emergency " and substituting " a declaration of a state of provincial emergency, or a declaration of a state of local emergency, made under the Emergency and Disaster Management Act ", and

(

c) by adding the following subsection:

(3) Subsection (2) applies in relation to a declaration of a state of local emergency as defined in

section 175 of the Emergency and Disaster Management Act .

Water Sustainability Regulation

Section 39 (1) (

o) of the Water Sustainability Regulation, B.C. Reg. 36/2016, is amended by striking out everything after " during " and substituting the following:

any of the following that involves flooding:

(

i) a declaration of a state of local emergency, as defined in

section 175 of the Emergency and Disaster Management Act ;

(ii) a declaration of a state of provincial emergency, or a declaration of a state of local emergency, made under the Emergency and Disaster Management Act ; .
