An Act to Perpetuate a Certain Ancient Right This Act to Perpetuate a Certain Ancient Right is significant in our democratic process. Its introduc- tion prior to consideration of the Throne Speech perpetuates the established right of Parliament, through the representatives elected by the people, to sit and act without leave from the Crown. This bill, therefore, asserts the right of this Legislative As- sembly to give precedence to matters other than those expressed by the Sovereign.

The practice dates back to the reign of Elizabeth I, when on the 22nd day of March, 1603 (just two days before her death) Parliament made this asser- tion of independence from the Crown for purposes of legislation. The Province of New Brunswick has always observed this tradition since 1789. Bill has often been a genuine bill, rather than a pro forma bill, such as this. Indeed, in 1856, four bills were intro- duced before the Throne Speech was considered.

The introduction of a genuine bill, it is felt, would cloud the origin and constitutional impor- tance of the first bill, and thus the custom would lose its significance. Ce projet de loi affirme donc le droit de cette Assemblée législative de donner priorité à des affaires autres que celles soulevées par la souve- raine. Cet usage remonte à la fin du règne d’Elizabeth I re, alors que le mars 1603 (deux jours avant la mort de la Reine) le Parlement affirma son indépen- dance de la Couronne en matière de législation. La province du Nouveau-Brunswick a observé cette tradition depuis 1789. Le Projet de loi fut souvent un vrai projet de loi et non seulement un projet de loi pro forma comme celui-ci.

En fait, quatre projets de loi furent déposés avant l’étude du Discours du trône en 1856. On croit que le dépôt d’un vrai projet de loi ris- querait de cacher l’origine et l’importance constitu- tionnelle du premier projet de loi et aussi de faire perdre à la coutume tout son sens. 2 Projet de loi Loi perpétuant un droit traditionnel spécifique For this reason, in the practice of introduc- ing a pro forma bill was initiated.
