B.C. Reg. 119/2006, deposited May 4, 2006, pursuant to the COURT RULES ACT [Section 1]. Order in Council 313/2006, approved and ordered May 4, 2006.
On the recommendation of the undersigned, made after consultation with the Chief Justice of the Supreme Court, the Administrator, by and with the advice and consent of the Executive Council, orders that
1 Rule 13 of the Supreme Court Rules, B.C. Reg. 221/90, is amended
(
a) by repealing subrule (1) and substituting the following:
Service outside British Columbia without leave
(1) Service of an originating process or other document on a person outside British Columbia may be effected without leave in any of the circumstances enumerated in
section 10 of the Court Jurisdiction and Proceedings Transfer Act . , and
(
b) in subrule (2) by striking out "grounds referred to in subrule (1)" and substituting "circumstances enumerated in
section 10 of the Court Jurisdiction and Proceedings Transfer Act ".
2 Form 6 is amended by striking out "[ State ground and provision in Rule 13 (1) upon which the plaintiff relies ]" and substituting "[ State the circumstances, enumerated in
section 10 of the Court Jurisdiction and Proceedings Transfer Act, on which the plaintiff relies] ".
