Section of the Family Services Act,

chapter F-2.2 of the Acts of New Brunswick, 1980, is amended L’article de la

a) by repealing subsection (3);

b) by adding before subsection (4) the following:

b) par l’adjonction de ce qui suit avant le paragra- phe (4) : 129(3.1) On application, the court may order, on the basis of the best interests of the child, that either parent, a grandparent, another member of the child’s immediate family or any other person shall have access to a child, whether or not an order for custody has been made with respect to the child. 129(3.1) Si on le lui demande, la cour peut rendre, en fonction de l’intérêt supérieur de l’enfant, une ordon- nance qui attribue à l’un de ses parents, à l’un de ses grands-parents, à un autre membre de sa proche famille ou à toute autre personne le droit de le visiter indépen- damment du fait qu’une ordonnance de garde ait été ren- due ou non à son égard. 129(3.2) An order under subsection (3.1) shall be made subject to the terms and conditions that the court determines. 129(3.2) La cour assortie l’ordonnance que prévoit le paragraphe (3.1) des conditions qu’elle juge indiquées. 129(3.3) On application by a grandparent or another member of the child’s immediate family, other than a pa- rent or guardian, the court shall take into consideration the willingness of each parent or guardian of the child to facilitate access and the need for making an order for ac- cess. 129(3.3) Sur demande d’un grand-parent ou d’un autre membre de la proche famille de l’enfant autre que son parent ou tuteur, la cour prend en considération la volon- té de chaque parent ou tuteur de faciliter l’accès et la né- cessité de rendre une ordonnance attributive de droit de visite. 1 129(3.4) An order under subsection (3.1) may provide that access be exercised in the form of visits, oral or written communication or by any other means of com- munication. 129(3.4) L’ordonnance que prévoit le paragraphe (3.1) peut établir que le droit de visite peut s’exercer par des visites, par des communications orales ou écrites ou par tout autre moyen de communication. 129(3.5) The court may vary or discharge an order un- der subsection (3.1) at any time. 129(3.5) La cour peut en tout temps modifier ou révo- quer l’ordonnance que prévoit le paragraphe (3.1). c) by repealing subsection (4) and substituting the following:
