Definitions Définitions 1 The following

definitions apply in this Act: 1 Les définitions qui suivent s’appliquent à la présente loi. “client” means a person or organization on whose be- half a consultant lobbyist undertakes to lobby. (client) “consultant lobbyist” means an individual who, for any form of remuneration or other benefit, undertakes to lobby on behalf of a client. (lobbyiste-conseil) “Crown” means Her Majesty in right of the Province. (Couronne) “lobby” means (

a) in relation to a consultant lobbyist or an in-house lobbyist, to communicate with a public office holder in an attempt to influence (

i) the development of any legislative proposal by the Government of New Brunswick or by a member of the Legislative Assembly, (ii) the introduction of any public bill or any reso- lution in the Legislative Assembly or the passage, defeat or amendment of any public Act or any reso- lution that is before the Legislative Assembly, (iii) the making or amendment of a regulation as defined in the Regulations Act, (iv) the development, amendment or termination of any policy or program of the Government of New Brunswick, (

v) a decision by the Executive Council to transfer from the Crown for consideration all or part of, or any interest in or asset of, any business, enterprise or institution that provides goods or services to the Crown or to the public, (vi) a decision by the Executive Council, a com- mittee of the Executive Council or a minister of the Crown to have the private sector instead of the Crown provide goods or services to the Crown, and « client » Personne ou organisation pour le compte de qui un lobbyiste-conseil s’engage à faire du lobbyisme. v) la décision du Conseil exécutif de transférer de la Couronne, moyennant contrepartie, soit tout ou

partie d’une entreprise, d’une activité ou d’un éta- blissement qui fournit des biens ou des services à la Couronne ou au public, soit un intérêt s’y rattachant, soit des éléments de son actif, (vi) la décision du Conseil exécutif, de l’un de ses comités ou d’un ministre de la Couronne de charger Projet de loi 2

(vii) the awarding of any grant, contribution or other financial benefit by or on behalf of the Crown; (

b) in relation to a consultant lobbyist, (

i) to arrange a meeting between a public office holder and any other person, and (ii) to communicate with a public office holder in an attempt to influence the awarding of any contract by or on behalf of the Crown. (lobbyisme) “organization” means (

a) a business, trade, industry, professional or volun- tary organization, (

b) a trade union or a labour organization, (

c) a chamber of commerce or a board of trade, (

d) an association, a charitable organization, a coali- tion or an interest group, (

e) a government, other than the Government of New Brunswick, and (

f) a body corporate, wherever or however incorpo- rated, without share capital incorporated to pursue, without financial gain to its members, objects of a na- tional, provincial, territorial, patriotic, religious, phi- lanthropic, charitable, educational, agricultural, scien- tific, artistic, social, professional, fraternal, sporting or athletic character or other similar objects. ( organisa- tion) “public office holder” means (

a) a member of the Legislative Assembly and any person on his or her staff, (

b) a member of the Executive Council and any per- son on his or her staff, (

c) a member of a District Education Council, (

d) a member of the board of directors of a regional health authority, (

e) an employee of any portion of the public service of the Province as specified in

Part 1, 2, 3 or 4 of the First

d) d’une association, d’un organisme de bienfai- sance, d’une coalition ou d’un groupe d’intérêt;

e) d’un gouvernement autre que celui du Nouveau- Brunswick;

f) d’une personne morale constituée sans capital- actions, indépendamment de son lieu ou de son mode de constitution, en vue de poursuivre, sans gain pécu- niaire pour ses membres, des objets de caractère natio- nal, provincial, territorial, patriotique, religieux, phi- lanthropique, caritatif, éducatif, agricole, scientifique, artistique, social, professionnel, fraternel, sportif ou athlétique ou des objets semblables. (organization) « registraire » La personne nommée à

titre de registraire des lobbyistes par l’article 22. (Registrar) « titulaire de charge publique » S’entend :

a) or subparagraph (b)(ii) of the definition “lobby” in

section 1,

4(3) This Act does not require identifying information about a person to be disclosed if the Registrar is satisfied that disclosure could reasonably be expected to threaten the person’s safety. 4(3) La présente loi n’a pas pour effet de rendre obliga- toire la divulgation de certains renseignements qui per- mettraient d’identifier une personne, si le registraire est convaincu qu’elle risquerait vraisemblablement de nuire à la sécurité de cette personne. REGISTRATION OF LOBBYISTS INSCRIPTION DES LOBBYISTES Division A Consultant lobbyist

Section A Lobbyistes-conseils Duty to submit return, consultant lobbyists Déclaration obligatoire : lobbyistes-conseils 5(1) A consultant lobbyist shall submit a return to the Registrar 5(1) Le lobbyiste-conseil remet une déclaration au re- gistraire avant l’expiration de l’un des délais suivants : (

a) within 15 days after commencing performance of an undertaking on behalf of a client, or

b) within 30 days after the expiration of each six- month period after the date the previous return was filed.

definitions apply in this Division: 9 Les définitions qui suivent s’appliquent à la présente section. “employee” includes an officer who is compensated for the performance of the officer’s duties. (employé) “in-house lobbyist” means an individual who is em- ployed by a person or partnership that is not an organiza- tion, (

a) a significant part of whose duties as an employee, as determined in accordance with the regulations, is to lobby on behalf of the employer or, if the employer is a corporation, on behalf of any subsidiary of the employer or any corporation of which the employer is a subsid- iary, or (

b) a part of whose duties as an employee is to lobby on behalf of the person or partnership or, where the person is a corporation, on behalf of any subsidiary of the corporation or any corporation of which the corpo- ration is a subsidiary, if the employee’s duties to lobby together with the duties of other employees to lobby would constitute a significant part of the duties of one employee, as determined in accordance with the regu- lations, if those duties to lobby were performed by only one employee. titre con- siste à faire du lobbyisme pour le compte de la personne ou de la société de personnes ou, dans le cas où celui- ci est une personne morale, pour le compte de l’une de ses filiales ou d’une personne morale dont il est la fi- liale, si ses fonctions de lobbyiste, combinées avec les fonctions de lobbyiste d’autres employés, constitue- raient une

Powers and duties Attributions 29 In addition to the other powers conferred or other duties imposed under this Act, the Registrar’s duties and functions include developing and implementing educa- tional programs to foster public awareness of the require- ments of this Act, particularly on the part of lobbyists, their clients and public office holders. 29 En plus des autres attributions que lui confère la pré- sente loi, le registraire est chargé d’élaborer et de mettre en oeuvre des programmes d’éducation relatifs aux exi- gences prévues par celle-ci en vue de sensibiliser à cet égard le public et en particulier les lobbyistes, leurs clients et les titulaires d’une charge publique.
