Wall, Queen's Printer, Edmonton BILL 12 THE JUDICATURE AMENDMENT ACT, 1972 (Assented to , 1972) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: 1. The Judicature Act is hereby amended.

Section 2, clause (

f) is amended by inserting after the words "'means a judge" the words "Oor supernumerary judge". 3. The following

section is added afteT

section 7: "1.1 For each office of judge established under s'ections and 7 1Jhere is an additional office of supernumerary judge whiClh any judge 'Of the Oourt may elect to hold upon com pliance with, and upon meeting the qualifications under, the Judges Act (Canada). 4. This Act C01nes into force on the day upon which it is assented to. Explanatory Notes l. This Bill amends

chapter of the Revised Statutes of Al berta to establish the offices of supernumerary judges to com plement federal amendments to the Judges Act. 2. Supernumerary judges included in the definition of judge. 3. Supernumerary judgeships established in correlation with the the new

section 20A of the Judges Act (Canada) which reads in part: 2OA.

(1) Where (

a) the legislature .of a province has enacted legtslation estabUshing for each office .of judge of the superi,or court or courts Df the pl'lovince the additional .office of supernumerary judge .of ,the eourt or courts, and (

b) a judge of a superior court .of a pr.ovince descr~bed in paragraph (

a) has notified the Minister of Justice ill Canada and the At torney General of that prov'ince of his election to give up his regular judical duties and hold 'o,Hiee .only as a supernumerary judge, that judge shal,l thereupon hold only the .office of supernumerary judge Df that court and there shall be paid to him the salary annexed to that offi'ce until he rea'ches the age Df seventy-five years, resigns, Dr is re moved ,from or otherwis.e ceases t,o hold office,

(2) No judge 000£ a superiDr court for which the office 100£ supernumerary judge has been estabHshed may elect to ho'ld office as a supernumerary judge Df that court unIe,ss he has aJttained the age of seventy years and continued in judicial office for at least ten years.

(3) A judge who has elected tOo hold the .ofifice of supernumerary judge shall hold himse,lf available to perform such special judicial duties as may be assigned tOo him from time tOI time by the chief jusUce lOT associate chief justice of the court of which he is a member.
