Ministerial Order No. 01/25
(Public Lands Act)
I, Andrew Boitchenko, Minister of Tourism and Sport, pursuant to
section 9.1 of
the Public Lands Act, make the order in the attached Appendix, being the All-Season
Resorts Fees, Rents and Other Amounts Payable Order.

APPENDIX
Definitions:
In this Order,
(a) "all-season resort area" means an all-season resort area designated-
under the All-season Resorts Act;
(b) "all-season resort development" means an all-season resort
development as defined in the All-season Resorts Act;
(c) "director" means a director designated by the Minister under
section 2
of the All-season Resorts Act;
(d) "gross revenue" means all revenue generated from recreational and
commercial operations located on an all-season resort area, including
(
i) any ticket sales, passes, ski school operations, food and beverage
services, retail operations, equipment rentals, lodging, and other
recreational activities, and
(ii) any revenue sources specified in a master development agreement
or all-season resort disposition,
but does not include sales taxes, employee benefits, income from sales
of operating equipment, refunds, sponsor contributions to special
events, any amount attributable to employees or volunteers, including
gratuities, discounts, tickets and passes, and any excluded revenue
sources specified in a master development agreement or all-season
resort disposition.
(e) "master development agreement" means a master development
agreement as defined in the All-season Resorts Act;
(f) "net revenue" means gross revenue less allowable operating expenses
directly incurred in the generation of gross revenue, including
(
i) wages, salaries, and employee benefits,
(ii) costs of goods sold for food, beverage, and retail activities,
(iii) maintenance, repairs, and utilities for facilities and equipment,
(iv) marketing, advertising, and promotional expenditures, and
(
v) any other expenses specified in a master development agreement
or an all-season resort disposition.
2 Fees
(1) The fee with respect to an application for an all-season resort disposition
shall be determined by the total area of public land proposed for the
all-season resort disposition and the fee shall range from
$10,000.00 - $80,000.00, as set out below:
(
a) Less than 300 hectare (ha) $10,000.00
(
b) Greater than 300 ha up to 1000 ha $30,000.00
(
c) Greater than 1000 ha up to 2000 ha $50,000.00
(
d) Greater than 2000 ha $80,000.00
(2) The fee with respect to the application for the amendment, renewal,
reinstatement or replacement of an all-season resort disposition, or approval
to mortgage an all-season resort disposition, is $400.00.
(3) The fee with respect to a single application for approval to assign one or
more all-season resort dispositions involving the same assignor(
s) and
assignee(
s) is $3,150.00.
(4) All of the fees set out in this Order are non-refundable, unless specifically
stated otherwise.
3 Rents
(1) Rents are only payable in relation to land designated as an all-season resort
area.
(2) The rents payable under an all-season resort disposition shall be the greater
of the minimum rent or the revenue sharing rent.
(3) Minimum rent is calculated as the greater of $10,000.00 per year or $2.00
per acre of public land under an all-season resort disposition;
(4) Revenue sharing rent is calculated using the following tiered brackets:
(a) 1.5% of gross revenue from $0.00 to $10,000,000.00;
(b) 2.5% of gross revenue from $10,000,000.00 to $50,000,000.00;
(c) 3.5% of gross revenue from $50,000,000.00 to $100,000,000.00;
and
(d) 5.0% of gross revenue above $100,000,000.00.
(5) The director may, in the director's discretion, deduct from the calculation of
gross revenue, the value of approved capital investment expenditures, where
such expenditures are deemed to constitute a public benefit.
(6) The total rents payable under
section 3 shall not exceed 30% of the net
revenue generated from recreational and commercial operations located on
an all-season resort area.

(All-Season Resorts Act)
I, Andrew Boitchenko, Minister of Tourism and Sport, hereby designate the
positions listed in the Appendix as Directors pursuant to
section 2 of the All-Season
Resorts Act.
These designations are subject to any limitations or restrictions that are set out in the
Appendix.
