An Act to Amend the Family Services Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section of the Family Services Act,

chapter F-2.2 of the Acts of New Brunswick, 1980, is amended by adding after subsection (2) the follow- ing: 54(2.1) Where, before the expiration of a supervi- sory order, the Minister applies under subsection 60(2) to have the supervisory order extended but the Court does not dispose of the application before the expiration of the supervisory order, the supervisory order remains in effect and the Minister continues to have, pending the disposition of the application, su- pervision of the child, the child’s family, the man- agement of their property and other affairs having a substantial bearing on the child’s security and de- velopment. 2

Section of the Act is amended (

a) in subsection (2.1) by striking out “Where” and substituting “Notwithstanding subsection (2), where”; PROJET DE LOI Loi modifiant la

chapitre F-2.2 des Lois du Nouveau- Brunswick de 1980, est modifié par l’adjonction, après le paragraphe (2), de ce qui suit : 54(2.1) Lorsque, avant l’expiration d’une ordon- nance de surveillance, le Ministre fait une demande en vertu du paragraphe 60(2) pour obtenir la proro- gation de cette ordonnance de surveillance mais que la cour ne statue pas sur la demande avant que l’or- donnance de surveillance soit expirée, l’ordonnance de surveillance demeure en vigueur et le Ministre continue d’exercer une surveillance sur l’enfant, sa famille et sur la gestion de leurs biens et autres af- faires ayant un rapport important à la sécurité et au développement de l’enfant en attendant que la cour ne statue sur la demande. 2 L’article de la Loi est modifié

a) au paragraphe (2.1), par la suppression de « Lorsque » et son remplacement par « Nonob- stant le paragraphe (2), lorsque »; 2 Projet de loi Loi modifiant la

Section of the Act is amended by adding af- ter subsection (4) the following: 58(4.1) Where, before the expiration of a protec- tive intervention order, the Minister applies under subsection 60(2) to have the protective intervention order extended but the Court does not dispose of the application before the expiration of the protective intervention order, the protective intervention order remains in effect pending the disposition of the ap- plication.

b) par l’adjonction, après le paragraphe (2.1), de ce qui suit : 55(2.2) Nonobstant le paragraphe (2), lorsque, avant l’expiration d’une ordonnance de garde, le Ministre fait une demande pour une ordonnance de tutelle en vertu du paragraphe 56(1) mais que la cour ne statue pas sur la demande avant que l’ordon- nance de garde soit expirée, l’ordonnance de garde demeure en vigueur et la garde, la charge et la direc- tion de l’enfant continuent de relever du Ministre en attendant que la cour ne statue sur la demande. 3 L’article de la Loi est modifié par l’adjonc- tion, après le paragraphe (4), de ce qui suit : 58(4.1) Lorsque, avant l’expiration d’une ordon- nance d’intervention protectrice, le Ministre fait une demande en vertu du paragraphe 60(2) pour obtenir la prorogation de cette ordonnance d’intervention protectrice mais que la cour ne statue pas sur la de- mande avant que l’ordonnance d’intervention pro- tectrice soit expirée, l’ordonnance d’intervention protectrice demeure en vigueur en attendant que la cour ne statue sur la demande. 3

Section New provision.

Section 2 (

a) The existing provision is as follows: 55(2.1) Where, before the expiration of a custody order, the Minister applies under subsection 60(2) to have the custody or- der extended but the Court does not dispose of the application before the expiration of the custody order, the custody order re- mains in effect and the custody, care and control of the child re- mains with the Minister pending the disposition of the applica- tion. (
