Section 8 of the Workplace Health, Safety and Com- pensation Commission Act,

chapter W-14 of the Acts of New Brunswick, 1994, is amended 1 L’article 8 de la

Loi sur la Commission de la santé, de la sécurité et de l’indemnisation des accidents au tra- vail,

chapitre W-14 des Lois du Nouveau-Brunswick de 1994 est modifié (

a) in subsection (1)

a) au paragraphe (1), (

i) by adding after paragraph (

a) the following: (

i) par l’adjonction après l’alinéa a ) de ce qui suit : (a.1) a Vice-Chairperson of the board of directors who, in the opinion of the Lieutenant-Governor in Council, is not representative of either workers or em- ployers, a.1) un vice-président du conseil d’administration qui, de l’avis du lieutenant-gouverneur en conseil, ne représente ni les travailleurs ni les employeurs, (ii) in paragraph (

b) in subsection (4) by striking out “as representa- tive of workers, employers or the general public” and substituting “as representative of workers or employ- ers”.

Section 9 of the Act is amended 2 L’article 9 de la Loi est modifié (

a) by adding after subsection (1) the following:

b) by repealing subsection (2) and substituting the following:

c) by repealing subsection (3) and substituting the following:

d) by repealing subsection (4);

b) a member who holds the office of Vice- Chairperson pursuant to subsection 9(3) of the Work- place Health, Safety and Compensation Commission Act immediately before the commencement of this

section shall not act as a Vice-Chairperson of the board of directors, unless appointed under paragraph 8(1)(a.1) of the Workplace Health, Safety and Com- pensation Commission Act.
