Definitions Définitions 1 The following

definitions apply in this Act. 1 Les définitions qui suivent s’appliquent à la présente loi. “Board” means the Labour and Employment Board es- tablished under the Labour and Employment Board Act . (Commission) “employer” means an operator as defined in the Nursing Homes Act. (employeur) « Commission » La Commission du travail et de l’em- ploi constituée en vertu de la

Request for designation Demande de désignation 5(1) In relation to a bargaining unit, an employer may, by notice in writing, advise the Board and the bargaining agent for the relevant bargaining unit that the employer considers in whole or in part the services provided by the bargaining unit to be essential in the interest of the health, safety or security of the residents of the nursing home. 5(1) Relativement à une unité de négociation, l’em- ployeur peut aviser par écrit la Commission et l’agent né- gociateur de l’unité de négociation pertinente que l’em- ployeur estime essentiels à l’intérêt de la santé, de la sûreté ou de la sécurité des pensionnaires du foyer de soins, en tout ou en partie, les services fournis par l’unité de négo- ciation. 5(2) A notice may be given 5(2) L’avis peut être donné : (

Time limits for agreement Délai pour la conclusion d’un accord 6 Within 7 days after the receipt by the Board of the notice referred to in

Agreement not reached Accord non conclu 8(1) If the employer and the bargaining agent are unable to reach agreement in relation to the matters referred to in

Amendments to an order or a determination Modification de l’ordonnance ou de la décision 9(1) The Board may, on the application of the employer or the bargaining agent for the relevant bargaining unit made within the time limits established in subsection (2), amend an order issued under

section 7 or a determination made under

Communication of the order or determination to employees Communication de l’ordonnance ou de la décision aux employés 11 Within the time and in the manner it prescribes, the Board shall inform all employees in a bargaining unit who are employed in positions agreed by the parties or deter- mined by the Board to be designated positions. 11 Dans le délai imparti et de la manière prescrite par la Commission, tous les employés d’une unité de négociation qui sont employés dans des postes convenus par les parties ou déterminés par la Commission comme étant des postes désignés en sont informés par la Commission.

Illegal strike and lock-out Grève et lock-out interdits 12(1) If a notice referred to in

section 5 is given by an employer or an application referred to in

Extension of the collective agreement Prorogation de la convention collective 13(1) Notwithstanding that the term of the collective agreement or arbitral award last in force between the em- ployer and the bargaining agent for the relevant bargaining unit has expired, the terms and conditions of employment contained in the agreement or award remain in force after the expiration of the agreement or award and apply in re- lation to an employee in the bargaining unit employed in a designated position who is required to work during a strike or a lock-out. 13(1) Même si la durée de la dernière convention col- lective ou sentence arbitrale en vigueur entre l’employeur et l’agent négociateur pour l’unité de négociation perti- nente a pris fin, les modalités et les conditions d’emploi contenues dans la convention ou la sentence continuent de s’appliquer relativement à un employé de l’unité de négo- ciation employé dans un poste désigné qui est tenu de tra- vailler pendant une grève ou un lock-out.

13(2) An employee employed in a designated position shall not, during a strike or a lock-out, be required to work more hours, including overtime, than the employee would have been required to work had the strike or lock-out not occurred. 13(2) Un employé dans un poste désigné ne peut, pen- dant une grève ou un lock-out, être tenu de travailler pen- dant un plus grand nombre d’heures, y compris les heures supplémentaires, pendant lesquelles l’employé aurait été tenu de travailler si la grève ou le lock-out n’était pas sur- venu.

section 14, on the application of the employer, the Board may re- voke the certification of the bargaining agent if the trade union or council of trade unions, or any officer, director, representative, employee, agent or advisor of the trade un- ion or counsel of trade unions, as the case may be, has been found guilty of violating or failing to comply with sub-

Loi sur les relations industrielles 16 For the purposes of this Act, sections 112, 113, 121, 124, paragraph 125 (1)(h), subsections 125 (2) to (5) and 126(1), paragraphs 126(2)(

j) and (k),

section 127, subsec- tions 128(1) and (3), sections 130 and 131, subsections 132(2) and 134 (3),

section 135, subsections 136 (1) to (4), 137(1) and 138 (2) and sections 140 and 141 of the Industrial Relations Act apply with the necessary modifi- cations. 16 Pour l’application de la présente loi, les articles 112, 113, 121, 124, l’alinéa 125(1)h), les paragraphes 125(2) à (5) et 126 (1), les alinéas 126

a) establish rules of procedure in respect of hearings held under sections 8 and 9, and
