OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works dated June 29, 2023, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and
Section 80 of
Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to: (
a) extinguish the right of the public to use that portion of the public highway, identified as Road Reserve "A", containing an area of 9,900 square feet (0.23 acres), more or less, located at or near Earl Court, Porters Lake, Halifax County, more particularly described in
Schedule "A" and as shown on
Schedule "B" attached to and forming part of the Report and Recommendation; (
b) authorize the conveyance of the parcel of surplus land, Road Reserve "A", to Hui Tai Liang and Lien Ngoc Trenh, both of Porters Lake, Halifax County, for the consideration of $2,000.00 plus HST of $300.00 for a total purchase price of $2,300.00; (
c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the land; and (
d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
