Bill No. 16 of 1937. A BILL TO AMEND THE FACTORIES ACT, 1926 NOTE.

Section 2 of the Bill amends the definition

section of the Act to meet the necessities arising out of the transfer of administration from the Bureau of Labour to the Depart ment of Public Works. Provision is made for the appointment of a Chief Factory Inspector to undertake the functions hitherto performed by the Commissioner of Labour. Further amendments exclude offices from the Act. R. An Act to amend The Factories Act, 1926. (Assented to , 1937.) HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows: ~. This Act may be cited as "The Factories Act, 1926, Amendment Act, 1937." 2. The Factories Act, 1926, being

chapter 52 of the Statutes of Alberta, 1926, is hereby amended as to

section 2 thereof,- (

a) by striking out paragraph (

c) thereof; (

b) by striking out the words "office or office building" where the same occur in paragraph (

e) and by sub stituting therefor the words "or office building"; (

c) by striking out paragraph (

g) and by substituting therefor the following: " (g) 'Inspector' shall mean any inspector appointed by the Lieutenant Governor in Council for enforcing the provisions of this Act and shall include the Chief Inspector" ; (

d) by striking out paragraph (j). 3. The said Act is further amended as to

section 4 by striking out the same. 4. The said Act is further amended as to

section 7 by adding at the end thereof the following: "

(3) This Act shall not apply to any shop in which the only persons employed are members of the employer's family." 5. The said Act is further amended as to

section 9 by striking out the words "office and office building" where the same occur therein and by substituting therefor the words "and office building". 6. The said Act is further amended as to sections 11 and 12 by striking out the word "Commissioner" wherever the same occurs therein and by substituting therefor the words "Chief Factory Inspector".

2 7. The said Act is further amended as to

section 13 thereof by striking out the word "offices" where the same occurs therein. 8. The said Act is further amended as to

section 14 thereof by striking out the same and by substituting therefor the following: "14. The Lieutenant Governor in Council may for the purposes of carrying out the provisions of this Act,- "(

a) appoint as many inspectors, male or female, as may be deemed necessary, one of whom he may designate as Chief Inspector, who shall have the general supervision and direction of the other inspectors and of the carrying out of the provisions of this Art; " (

b) make such regulations for carrying out the pro visions of this Act as may be deemed necessary." ~. The said Act is further amended as to

section 15 by striking out the words "office and office building" wherever the same occur therein and by substituting therefor the words "or office building". 10. The said Act is further amended by inserting therein immediately after

section 15 the following new section: "15a. Every Inspector shall be furnished with a certifi cate of his appointment under the hand and seal of the Min ister and on applying for admission to any premises shall if required produce such certificate." 11. The said Act is further amended as to

section 18 by striking out the words "office or office building" where the same occur therein and by substituting therefor the words "or office building". 12. The said Act is further amended as to

section 19 by striking out the words "office or office building" where the same occur therein and by substituting therefor the words "or office building". 13. The said Act is further amended as to

section 20 thereof,- (

a) by striking out the words "office or office building" where the same occur in subsection (1) thereof and by substituting therefor the words "or office build ing"; (

b) by striking out subsections (2) and (3) thereof. 14. The said Act is further amended as to

section 22 thereof by striking out the word "office" where the same occurs therein and by substituting therefor the words "office building".

3 15. The said Act is further amended as to

section 24 thereof by striking out the same. 16. The said Act is further amended as to

section 26 thereof,- (

a) by striking out the words "office or office building" wherever the same occur therein and by substitut ing therefor the words "or office building"; and (

b) by striking out the words "by mechanical means" where the same occur in subsection (3). 17. The said Act is further amended as to

section 31 thereof by striking out the word "Commissioner" where the same occurs in subsection (2) and by substituting therefor the words "Chief Factory Inspector". 18. The said Act is further amended as to

section 34 thereof by striking out the words "In every factory" where the same occur in subsection (1) thereof and by substituting therefor the words "In every factory, shop or office build ing". 19. The said Act is further amended as to

section 35 thereof by striking out the words "factory or shop" wherever the same occur therein and by sUbsituting therefor the words "factory, office building or shop". 20. The said Act is further amended as to

section 37 thereof by striking out the words "office or office building" wherever the same occur therein and by substituting there for the words "or office building". 21. The said Act is further amended as to

section 38 thereof,- (

a) by striking out the words "office or office building" wherever the same occur in subsection (1) and by substituting therefor the words "or office building" ; (

b) by striking out the words "Bureau of Labour" where the same occur therein and by substituting therefor the words "Chief Factory Inspector". 22. The said Act is further amended as to

section 40 by striking out subsection (2) thereof. 23. The said Act is further amended as to

section 50 thereof by striking out the same. 24. The said Act is further amended as to the

Schedule thereto by striking out the words "Automobile factories and repair shops" where the same occur therein and by sub stituting therefor the words "Automobile factories, repair shops and service stations". 25. This Act shall come into force on the day upon which it is assented to.
