Eastern Shore Wildlife Management Area Regulations

made under

Section 113 of the

Wildlife Act

R.S.N.S. 1989, c. 504

O.I.C. 73-1351 (Effective December 1, 1976), N.S. Reg. 104/1976

1 In these regulations,

(a) “Act” means the Lands and Forests Act ;

(b) “Minister” means the Minister of Lands and Forests;

(c) “Department” means the Department of Lands and Forests;

(

d) notwithstanding clause (

n) of

Section 84 of the Act a “warden” includes any

person appointed by the Minister for the preservation and maintenance of

the public peace and enforcement of the statutes coming under the

jurisdiction of the Department;

(e) “firearm”means any bow or barrelled weapon from which any shot, bullet or

other missile that is capable of causing serious injury or death can be

discharged and includes anything that can readily be adapted for use as a

firearm;

(f) “Management Area” means the Eastern Shore Islands Wildlife Management

Area.

2 Except as provided in these regulations, no person shall

(

a) kill, take, hunt, or pursue or attempt to kill or take any wild mammal or

bird; or

(

b) have in his possession any firearm, trap, snare, or poison or any wild

mammal or bird or the carcass or any part of any wild mammal or bird

within the limits of the Management Area.

(1) No person shall enter or be within the Management Area during the period April 1

to August 15 of any year.

(2) Notwithstanding subsection (1) any person may enter and be within the limits of

the Management Area

(

a) if the person is a bona fide commercial fishermen retrieving lobster traps or

other materials essential to his business operations; or

(

b) if the person is in possession of written permission of the Minister or his

agent.

4 Subject to

Section 3, the hunting of wildlife in the Management Area is permitted during

the open season as determined by Provincial and Federal statutes.

6 Where the Minister proposes to permit limited hunting, within the Management Area, he

shall give public notice thereof in at least one edition of a newspaper having general

circulation in the Province.

7 The Minister may specify the number of persons that will be permitted to enter the

Management Area on any one day for the purpose of hunting.

8 Every person authorized by the minister or his agent to enter the Management Area shall

(

a) follow all instructions issued by the Minister or his agent with respect to his

activities within the Management Area;

(

b) subject to these regulations, comply with the provisions of Provincial and

Federal Statutes pertaining thereto, and any regulations made thereunder;

(

c) file a report as required by the Minister or warden; and

(

d) turn over to a warden any part of the carcass of any wild mammal or bird

killed or taken within the Management Area.

9 No person shall, within the Management Area, destroy, disturb or molest in any way the

habitat or nesting sites of any mammals or birds found therein.

10 Any bag limit specified by the Lands and Forests Act , Acts of the Parliament of Canada

pertaining thereto, and any regulation made thereunder shall include any mammal or bird

taken within the Management Area during the open season for such mammals or birds as

determined by statute.

11 Any person convicted of a violation of any of the provisions of these regulations shall

incur a penalty of not less than one hundred dollars nor more than five hundred dollars.

12 These regulations shall come into force on the 1st day of December, 1976.

The designation for this wildlife management area is consolidated separately.

Effective date is specified in

Section 12 of the regulations.

Sections 84 and 123 to 220 of the Lands and Forests Act , R.S.N.S. 1967, c. 163, are repealed by

Section 114 of the Wildlife Act , S.N.S. 1987, c. 13, and the Lands and Forests Act is repealed by the Crown Lands Act , S.N.S. 1987, c. 5. The designation and regulations are continued under

Section 112 of the Wildlife Act .
