Section 1 of the Higher Education Foundation Act ,

chapter H-4.1 of the Acts of New Brunswick, 1992, is amended 1 L’article 1 de la

chapitre H- 4.1 des Lois du Nouveau- Brunswick de 1992, est modifié (

a) by repealing the definition “institution” and substituting the following:

a) par l’abrogation de la définition « établissement » et son remplacement par ce qui suit : “institution” means a community college, an educa- tional institution or a university; « établissement » désigne un collège communautaire, un établissement d’enseignement ou une université; (

b) in the definition « fondation » in the French version by striking out “établie” and substituting “constituée”.

Section 2 of the Act is repealed and the following is substituted: 2 L’article 2 de la Loi est abrogé et remplacé par ce qui suit : 2(1) One or more foundations may be established by regulation for one institution or for 2 or more institutions. 2(1) Une ou plusieurs fondations peuvent être consti- tuées par règlement pour un établissement ou pour deux ou plusieurs d’entre eux. 2(2) A foundation may be continued by regulation for one institution or for 2 or more institutions. 2(2) Une fondation peut être prorogée par règlement pour un établissement ou pour deux ou plusieurs d’entre eux. 3

Section 3 of the Act is amended 3 L’article 3 de la Loi est modifié 1

a) in paragraph (

a) by striking out “the institu- tion,” and substituting “the institution or institu- tions,”;

c) and substituting the following:

c) by repealing paragraph (

d) to make grants and gifts to the institution or insti- tutions in support of the programs and activities of the institution or institutions.

Section 7 of the Act is amended 4 L’article 7 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) three trustees appointed by the Lieutenant- Governor in Council on the recommendation of the in- stitution; and

b) two trustees appointed by the Lieutenant- Governor in Council.

a) those trustees appointed by the Lieutenant- Governor in Council on the recommendation of the in- stitutions; and

Section 12 of the Act is amended 5 L’article 12 de la Loi est modifié (

a) by repealing subsection (2) and substituting the following:
