An Act to Amend the Safer Communities and Neighbourhoods Act Loi modifiant la Loi visant à accroître la sécurité des communautés et des voisinages Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1

Section 8 of the Safer Communities and Neigh- bourhoods Act,

chapter S-0.5 of the Acts of New Brunswick, 2009, is amended by adding the following after subsection (2): 1 L’article 8 de la Loi visant à accroître la sécurité des communautés et des voisinages,

chapitre S-0.5 des Lois du Nouveau-Brunswick de 2009, est modifié par l’adjonction de ce qui suit après le paragraphe (2) : 8(2.1) As soon as the circumstances permit after filing a notice of application for a community safety order, the Director shall serve a copy of the notice of application on the respondent in accordance with the regulations. 8(2.1) Dès que les circonstances le permettent après avoir déposé une demande visant l’obtention d’une or- donnance de sécurité des communautés, le directeur en signifie copie à l’intimé conformément aux règlements. 2

Section 15 of the Act is amended by adding the fol- lowing after subsection (1): 2 L’article 15 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (1) : 15(1.1) For the purposes of subsection (1), if the court is satisfied that a property is being habitually used for a specified use, there is a rebuttable presumption that the community or neighbourhood is adversely affected by the activities. 15(1.1) Aux fins d’application du paragraphe (1), si la cour est convaincue que la propriété sert habituellement à des fins déterminées, il existe une présomption réfuta- ble selon laquelle la communauté ou le voisinage subit les conséquences négatives de ces activités. 3

Section 16 of the Act is amended by adding the fol- lowing after subsection (1): 3 L’article 16 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (1) : 16(1.1) As soon as the circumstances permit after fil- ing a notice of application to vary a community safety order, the Director shall serve a copy of the notice of ap- plication on the respondent in accordance with the regu- lations. 16(1.1) Dès que les circonstances le permettent après avoir déposé une demande de modification d’une ordon- nance de sécurité des communautés, le directeur en si- gnifie copie à l’intimé conformément aux règlements. 1

4 Paragraph 23(1)(

a) of the English version of the Act is amended by striking out “serve a copy of the ap- plication” and substituting “serve a copy of the notice of application”. 4 L’alinéa 23(1)(

section 32: 5 La Loi est modifiée par l’adjonction de ce qui suit après l’article 32 : Affidavits based on information and belief Affidavit fondé sur des renseignements tenus pour véridiques 32.1 An affidavit of the Director in support of an ap- plication for a community safety order or an application to vary a community safety order may contain informa- tion relevant to the application that is provided to the Di- rector by a person under

section 9 or a complainant, without specifying the source of the information or the reasons for the Director’s belief in that information. 32.1 L’affidavit du directeur à l’appui d’une demande visant l’obtention d’une ordonnance de sécurité des com- munautés ou d’une demande de modification d’une or- donnance de sécurité des communautés peut renfermer des renseignements se rapportant à la demande qui lui ont été fournis par une personne en application de l’arti- cle 9 ou par un plaignant, sans qu’il soit nécessaire d’y spécifier la source de ces renseignements ni ses raisons d’y croire. 6

Section 74 of the Act is amended by adding after paragraph (

section 3 the following: 7 Le Règlement du Nouveau-Brunswick 2010-66 pris en vertu de la Loi visant à accroître la sécurité des communautés et des voisinages est modifié par l’ad- jonction de ce qui suit après l’article 3 : Service of notice of application on respondent Signification à l’intimé d’une demande 3.1(1) A notice of application for a community safety order or a notice of application to vary a community safety order that is to be served on a respondent shall be sufficiently served 3.1(1) La suffisance d’une demande visant l’obtention d’une ordonnance de sécurité des communautés ou d’une demande de modification d’une ordonnance de sécurité des communautés qui doit être signifiée à l’intimé est as- sujettie à l’une ou l’autre des conditions suivantes : (

a) if it is served in the manner in which personal service may be made under the Rules of Court, or

a) le document est signifié selon les modalités que prévoient les Règles de procédure pour la significa- tion personnelle; (

b) if it is mailed by registered mail to the last known address of the respondent and it is posted in a conspicuous place on the property in respect of which the application is made.

3.1(2) A notice of application sent by registered mail shall be deemed to have been received by the respondent 7 days after the day of mailing. 3.1(2) Le document expédié par courrier recommandé est réputé avoir été reçu par l’intimé le septième jour qui suit la date de sa mise à la poste.
