Section 3 8.22 of the Workers’ Compensation Act,

chapter W-13 of the Revised Statues, 1973, is amended L’article 38.22 de la

a) by repealing subsection (1) and substituting the following:

section 38.11 for a period exceeding twenty-four consec- utive months, the Commission shall set aside an amount, commencing in the twenty-fifth month, to be used with the interest that accrues on that amount to provide a pension for the worker at age sixty-five or to be disbursed in ac- cordance with subsection (13). 38.22(1) Dans les cas où une indemnité est versée à un travailleur en vertu de l’article 3 8.11 pendant plus de vingt-quatre mois consécutifs, la Commission réserve, à compter du vingt-cinquième mois, une somme qui, avec les intérêts courus, servira à payer une pension au travail- leur à l’âge de soixante-cinq ans ou sera versée selon ce qui est prévu au paragraphe (13). b) par l’adjonction après le paragraphe (1) de ce qui suit : 38.22(1.1) The amount under subsection (1) shall be calculated by multiplying the percentage prescribed below times the amount of compensation paid beginning from the twenty-fifth consecutive month to the worker’s sixty- fifth birthday or until the worker dies, whichever occurs first: 38.22(1.1) La somme dont il est question au paragraphe (1) est calculée en multipliant le montant de l’indemnité versée à compter du vingt-cinquième mois jusqu’au soixante-cinquième anniversaire ou jusqu’au décès du tra- vailleur, l’évènement qui se produit en premier lieu étant celui à retenir, par les pourcentages que voici : (a) 5% for the period between January 1, 1998, to December 31, 2008; and a) 5 % pour la période comprise entre le er janvier et le décembre 2008; et (b) 10% from January 1, 2009, onwards. b) 10 % à partir du 1er janvier 2009. 1 38.22(1.2) Notwithstanding subsection (1.1), if a worker reaches the age of sixty-five on or after January 1, 2009, or if the worker dies on or after January 1, 2009, but before reaching the age of sixty-five, the Commission shall set aside for the worker’s account in the Pension Fund such amount of money as though it had been paid into the ac- count at the rate of 10% plus interest accrued at the rate prescribed in subsection (9), and such sum shall be used to provide a pension to the worker at age sixty-five or to be disbursed in accordance with subsection (13). 38.22(1.2) Nonobstant le paragraphe (1.1), dans le cas où le travailleur atteint l’âge de soixante-cinq ans après le décembre ou dans le cas où il décède après cette date avant d’avoir atteint soixante-cinq ans, la Commis- sion doit réserver une somme pour le compte du travailleur dans la Caisse de retraite tout comme si elle avait été portée au crédit de ce compte au taux de 10 % plus les intérêts courus selon les taux prescrits au paragraphe (9) et cette somme sert à payer une pension au travailleur à l’âge de soixante-cinq ans ou est versée selon ce qui est prévu au paragraphe (13). section 38.2 for a period exceeding twenty-four consecutive months, the Commission shall set aside an amount, com- mencing in the twenty-fifth month, to be used with the interest that accrues on that amount to provide a pension for the worker at age sixty-five or to be disbursed in ac- cordance with subsection (13). 38.22(2)
