EXPLANATORY NOTE NOTE EXPLICATIVE This Bill amends The Environment Act. Le présent projet de loi modifie la

Loi sur l'environnement. The prohibition on the application of certain pesticides to lawns is removed and the sale of those pesticides is no longer subject to provincial regulations. L'interdiction visant l'application de certains pesticides sur les pelouses est levée et la vente de ces pesticides n'est plus assujettie aux règlements provinciaux. The list of premises where the use of those pesticides is prohibited is expanded to include municipal playgrounds, picnic areas, dog parks and provincial parks.

La liste des endroits où l'utilisation de ces pesticides est interdite est élargie afin d'y inclure les terrains de jeux municipaux, les aires de pique-nique, les parcs canins et les parcs provinciaux.

Section 40.4 is repealed. 2

Section 40.5 is amended by renumbering it as subsection 40.5(1) and adding the following as subsection 40.5(2): 3

L'article 40.5 est modifié par substitution, à son numéro, du numéro de paragraphe 40.5(1) et par adjonction, après ce paragraphe, de ce qui suit : Prohibiting pesticide use on public green spaces 40.5(2) No person shall use or cause or permit the use of a prescribed pesticide in, on or over (

a) a municipal playground, picnic area or dog park; or (

Section 40.6 is amended, in the part before clause (a), by striking out "Sections 40.4 and 40.5" and substituting "The prohibitions in

section 40.5". 4

Section 40.7 is repealed. 5

Section 40.8 is amended by striking out "Sections 40.4, 40.5 and 40.7" and substituting "The prohibitions in

Section 40.9 is amended (

a) by repealing clause (b); and (

b) in clause (e), by striking out "sections 40.4 to 40.8" and substituting "sections 40.5, 40.6 and 40.8". 7

a) in the part before the

definitions, by striking out "sections 40.4 to 40.9" and substituting "sections 40.5 to 40.9"; and (

b) by repealing the

definitions "lawn" and "sell". 8
