Alberta Regulation 85/2021

Cooperatives Act

COOPERATIVES AMENDMENT REGULATION

on April 19, 2021 pursuant to

section 49(a), (b), (

h) and (cc) of the Cooperatives Act.

1 The Cooperatives Regulation (AR 55/2002) is amended

by this Regulation.

Section 17 is repealed and the following is substituted:

Electronic meetings

17(1) Unless the by-laws expressly provide otherwise,

(

a) a person entitled to attend a meeting of members or

investment shareholders may attend the meeting by

electronic means,

(

b) a meeting of members or investment shareholders may be

held entirely by electronic means, and

(

c) a person attending a meeting by electronic means under

clause (

a) or (

b) is deemed for the purposes of this

Regulation to be present in person at the meeting.

Section 20 is amended

(

a) in subsection (1) by striking out "the date, time and

place of";

(

b) by adding the following after subsection (1):

(1.1) A notice under subsection (1) must set out the date and

time of the meeting and

(

a) the location at which the meeting will be held, or

(

b) in the case of a meeting that is to be held, or that a

person may attend, by electronic means, the information

required for attendees to access the meeting.

Section 38(1) is amended by striking out "Voting" and

substituting "Subject to

section 39, voting".

Section 39 is repealed and the following is substituted:

Electronic voting

39(1) Unless the by-laws expressly provide otherwise, a person who

is entitled to vote at a meeting of a cooperative and who attends the

meeting by electronic means may vote by any electronic, telephonic

or other method made available by the cooperative for that purpose.

(2) A vote may be held entirely by an electronic, telephonic or other

method only if the method

(

a) is made available to each person entitled to vote,

(

b) permits the subsequent verification of the votes that are

gathered, and

(

c) permits the tallied votes to be presented to the cooperative

without it being possible for the cooperative to identify how

each person or group of persons voted.

6 This Regulation has effect on August 15, 2020.

Traffic Safety Act

ACCESS TO MOTOR VEHICLE INFORMATION

AMENDMENT REGULATION

on April 21, 2021 pursuant to

section 8 of the Traffic Safety.

1 The Access to Motor Vehicle Information Regulation

(AR 140/2003) is amended by this Regulation.

Section 1 is amended

(

a) by repealing clauses (d.1) and (d.2);

(

b) by adding the following after clause (e):

(f) "registry agent" means a registry agent as defined in

Schedule 12 of the Government Organization Act.

Section 2 is amended

(

a) in subsection (1)

(

i) by adding the following after clause (a):

(a.1) only to a federal, provincial or territorial

government, only for the purpose of registering

vehicles and licensing drivers,

(a.2) only to the Interprovincial Record Exchange

managed by the Canadian Council of Motor

Transport Administrators, only for the purpose of

providing the information to an eligible

government under clause (a.1),

(a.3) only to the Canadian Police Information Centre,

only for the purpose of providing the information

to an eligible public body or a law enforcement

agency under clause (j),

(ii) by repealing clause (j.1);

(iii) by repealing clause (j.2) and substituting the

following:

(j.2) only to the Insurance Crime Prevention Bureau, a

division of the Insurance Bureau of Canada, for the

purposes of investigating theft, fraud, possession

of stolen property or any other illegal activity,

offence or crime related to or associated with

motor vehicles,

(iv) in clause (

l) by adding "and" at the end of

subclause (i), by striking out "and" at the end of

subclause (ii) and by repealing subclause (iii);

(

b) in subsection (3)

(

i) in clause (

a) by adding ", dated" after "in writing";

(ii) by striking out "and" at the end of clause (b), by

adding "and" at the end of clause (

c) and by

adding the following after clause (c):

(

d) must be given for a specified period of time that

shall not exceed 3 years, unless otherwise

prescribed by the Registrar.

(

c) by repealing subsections (5) to (7).

Section 3(1) is amended by adding "and that the agreement is

filed with the Registrar" after "with this section".

Section 4 is amended

(

a) in subsection (1)

(

i) in clause (

a) by striking out ", Department of

Service Alberta";

(ii) by repealing clause (

b) and substituting the

following:

(

b) regarding the information to be or not to be

released by the Registrar, including information

regarding

(

i) the categories of information to be or not to

be released,

(ii) the channel or method by which information

is to be released,

(iii) a description of any new motor vehicle

information product to be used to release

information,

(iv) the person or category of persons to whom

the information is or is not to be released, and

(

v) requirements respecting information that may

be released for the purposes referred to in

section 2(1)(

d) and (m).

(

b) by repealing subsection (2);

(

c) by adding the following after subsection (4):

(5) In this section, "motor vehicle information product" means a

specific compilation of motor vehicle information released by the

Registrar as a product.

Section 5 is amended

(

a) in subsection (1)(

b) by striking out "or" at the end of

subclause (iv), by adding "or" at the end of

subclause (v), and by adding the following after

subclause (v):

(vi) to an individual if that individual is personally known to

the person who is the subject of the abstract and the

individual

(

A) has a written authorization from the person who is

the subject of the abstract authorizing the abstract

to be released to that individual,

(

B) signs a statutory declaration in the office of a

registry agent in a form acceptable to the Registrar,

and

(

C) affirms that the request is for the purpose of

providing the abstract to the person who is the

subject of the abstract.

(

b) in subsection (1.1) by adding "or (1)(b)(ii)" after

"(1)(b)(i.2)";

(

c) by repealing subsection (1.2);

(

d) by adding the following after subsection (2):

(2.1) For the purposes of subsection (1)(b)(iii), (

v) and (vi),

consent must be given in writing and must satisfy the

requirements in

section 2(4).

(

e) by repealing subsection (3).

Section 8 is amended by striking out "April 30, 2021" and

substituting "April 30, 2026".

8 This Regulation, except

section 7, comes into force on

October 30, 2021.

Family and Community Support Services Act

FAMILY AND COMMUNITY SUPPORT SERVICES

AMENDMENT REGULATION

section 7 of the Family and Community Support

Services Act.

1 The Family and Community Support Services Regulation

(AR 218/94) is amended by this Regulation.

Section 2.1 is amended

(

a) in subsection (2)(

b) by striking out "offer" and

substituting "subject to subsection (3), offer";

(

b) by adding the following after subsection (2):

(3) Services provided under a program may offer direct

assistance including money, food, clothing or shelter to sustain

an individual or family during a public health emergency under

the Public Health Act or any extenuating circumstances such as

fire or flood as the Minister may determine.

Section 3 is amended

(

a) by repealing clause (

f) and substituting the

following:

(

f) monitoring and evaluation of the services provided

under the program in the municipality,

(

b) by repealing clause (

g) and substituting the

following:

(

g) evaluating the service delivery effectiveness of the

program,

(

c) by repealing clause (

h) and substituting the

following:

(

h) advertising and promoting the services to be provided

under the program in the community,

(

d) by repealing clause (

j) and substituting the

following:

(

j) operating a board or committee for the delivery of the

services under the program,

(

e) by repealing clause (

k) and substituting the

following:

(

k) providing training for staff and volunteers for the

delivery of services under the program,

(

f) by repealing clause (

m) and substituting the

following:

(

m) employment of staff to deliver family and community

support services under the program.

Section 6 is amended by striking out "$100 000" and

substituting "$250 000".

Section 6.1 is amended by striking out "$100 000" and

substituting "$250 000".

Section 12 is repealed.

Section 13 is amended by striking out "June 30, 2022" and

substituting "June 30, 2032".

8 This Regulation comes into force on July 1, 2021.

VITAL STATISTICS INFORMATION

AMENDMENT REGULATION

1 The Vital Statistics Information Regulation (AR 108/2018)

is amended by this Regulation.

2 Sections 8(8), 22(4), 23(3) and 38(1)(

g) are amended by

striking out "burial permit" wherever it occurs and

substituting "burial and disposition permit".

Section 45 is amended by striking out "October 31, 2021"

and substituting "October 31, 2026".

4 This Regulation comes into force on the coming into

force of

section 2(

a) of the Vital Statistics Amendment Act,

Unclaimed Personal Property

and Vested Property Act

GENERAL AMENDMENT REGULATION

on April 28, 2021 pursuant to

section 64 of the Unclaimed Personal Property and

Vested Property Act.

1 The General Regulation (AR 104/2008) is amended by

this Regulation.

2 The following is added after

section 3:

Trusts re certain intangible personal property

3.1 The Act applies to unclaimed intangible personal property held

in and distributable from a trust established in connection with

(

a) the acquisition, reorganization or restructuring of an issuer,

(

b) the demutualization of a business organization.

Section 8 is amended by adding the following after

subsection (3):

(4) Where the Minister does not know the identity of an apparent

owner of unclaimed personal property, the Minister is not required to

provide notice to any person, but shall include the information

required by

section 9(3) of the Act and subsection (2), to the extent

known, in the Registry.

Section 24 is amended by striking out "May 1, 2021" and

substituting "May 1, 2024".
