An Act to Amend the Off-Road Vehicle Act Loi modifiant la

Section 1 of the Off-Road Vehicle Act,

chapter O-1.5 of the Acts of New Brunswick, 1985, is amended 1 L’article 1 de la

a) by repealing the definition “all-terrain vehicle” and substituting the following:

a) an amphibious vehicle,

definitions in alphabet- ical order:

b) par l’adjonction des définitions qui suivent dans leur ordre alphabétique : “amphibious vehicle” means an off-road vehicle that is designed or adapted for operation on both land and water; “side-by-side” means an off-road vehicle, other than a dune buggy, with side-by-side seating for the operator and at least one passenger that has a steering wheel, at least four driving wheels and a net mass of not more than 700 kg; “utility vehicle” means an off-road vehicle that is de- signed for operation over rough terrain and (

a) has at least four wheels and seating for at least two persons, (

b) has an engine displacement of at most 1000 cm3, a maximum engine brake power of at most 30 kW and a maximum vehicle speed of at least 40 km/h, and (

c) qui ou bien a une charge utile arrière d’au moins 159 kg, ou bien compte au moins six places pour des passagers. 2 Paragraph 3(1)(

Section 7.4 of the Act is amended 4 L’article 7.4 de la Loi est modifié (

a) a description of any conditions that apply to either party in relation to the verbal consent, and

section 20 the following: 7 La Loi est modifiée par l’adjonction de ce qui suit après l’article 20 : 20.1 No person shall drive an off-road vehicle if the per- son has his or her driving privilege suspended under the Motor Vehicle Act as a result of a conviction for an offence under

Section 22 of the Act is amended 8 L’article 22 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 22(1) No person shall drive an off-road vehicle unless it is outfitted with the equipment required under this

b) in subsection (2)

a) it is not equipped with a muffler and exhaust sys- tem in continuous operation and in good working order that comply with the manufacturer’s original specifica- tions or, if the muffler or exhaust system was replaced, that complies with the equivalent manufacturer’s spec- ifications of the replacement muffler or exhaust system,
