Loi sur le transport des produits forestiers de base Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 Subsection 2 (1) of the Transportation of Primary Forest Products Act,

chapter T-11.02 of the Acts of New Brunswick, 1999, is amended by striking out “a properly completed” and substituting “an accurately completed”. 1 Le paragraphe 2 (1) de la

Section 3 of the Act is amended 2 L’article 3 de la Loi est modifié (

a) in subsection (1) by striking out “properly com- pleted” and substituting “accurately completed”;

section 2 (1) applies is in possession of a transportation certificate that contains false or misleading statements, he or she commits an offence and the following persons are parties to the offence: 3.01(1) Commet une infraction le conducteur d’un vé- hicule auquel s’applique le paragraphe 2(1) qui se trouve en possession d’un certificat de transport, lequel comporte des déclarations fausses ou trompeuses, et sont parties à l’infraction : 1

(

a) the owner of the land from which the primary for- est products originated; and

a) le propriétaire du terrain d’où proviennent les pro- duits forestiers de base; (

b) the wood contractor for whom the primary forest products were harvested.

b) l’entrepreneur forestier pour qui ces produits sont récoltés. 3.01(2) The owner of the land or the wood contractor may be charged with, convicted of and sentenced for the offence under subsection (1), whether or not the operator of the vehicle is charged with or convicted of the offence. 3.01(2) Le propriétaire du terrain ou l’entrepreneur fo- restier peut être accusé de l’infraction prévue au paragra- phe (1), déclaré coupable de cette infraction et se voir im- poser une sentence pour cette infraction, que le conducteur du véhicule soit accusé ou non d’avoir commis l’infraction ou qu’il soit déclaré coupable ou non de l’avoir commise. 3.01(3) No person shall be convicted of an offence under subsection (1) if he or she exercised due diligence to pre- vent its commission. 3.01(3) Nul ne peut être déclaré coupable de l’infraction prévue au paragraphe (1) s’il est établi qu’il a fait preuve de diligence raisonnable pour empêcher sa commission. 4 Subsection 3.1(1) of the Act is amended by striking out “a properly completed” and substituting “an accu- rately completed”. 4

Section 9 of the Act is amended 6 L’article 9 de la Loi est modifié (

a) by renumbering the

section as subsection 9(1);

b) in subsection (1) by striking out “knowingly”;

section 11 the following: 7 La Loi est modifiée par l’adjonction de ce qui suit après l’article 11 : Limitation period Délai de prescription 11.1 A prosecution of an offence under this Act or the regulations shall be commenced within one year after the date on which the offence was, or is alleged to have been, committed. 11.1 Toute poursuite pour infraction à la présente loi ou aux règlements est intentée dans l’année qui suit la date à laquelle l’infraction a été ou aurait été commise. 8

Schedule A of the Act is repealed and the attached
