B.C. Reg. 448/2003, deposited December 5, 2003, pursuant to the ASSESSMENT ACT [Section 22 (1) (a)]. Order in Council 1173/2003, approved and ordered December 4, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that B.C. Regulation 328/96, the Exclusion of Railway Bridges from the Definition of Improvements Regulation, is amended

(

a) by repealing the title and substituting "Exclusion of Railway Bridges and Tunnels from the Definition of Improvements Regulation",

(

b) by repealing

section 1 and

Schedule 1, and

(

c) by adding the following section:

Exclusion of tunnels

2.1 Tunnels that carry track in place of a railway corporation are excluded from the definition of improvements in

section 1 of the Assessment Act . — S. HAGEN, Minister of Sustainable Resource Management; G. ABBOTT, Presiding Member of the Executive Council.
