OIC Text: The Governor in Council on the report and recommendation of the Minister of Education dated June 3, 2003, and pursuant to

Section 88 of

Chapter 1 of the Acts of 1995-96, the Education Act, is pleased to: (

a) approve the construction of a new Barrington High School for the Southwest Regional School Board, scheduled for completion for September 2005, at a total cost not to exceed $11,500,000, in accordance to the School Space Program set forth in

Schedule "A", attached to and forming part of the report and recommendation; (

b) approve the allocation of funding in the amount of $11,500,000 to cover costs of this project to be allocated in fiscal years 2003/04, 2004/05 and 2005/06; the total costs will subsequently be funded through the Tangible Capital Assets allocation of the Department of Education in subsequent years in the estimated amounts of $1,500,000 for the 2003/04 fiscal year, $7,150,000 for the 2004/05 fiscal year and $2,850,000 for the 2005/06 fiscal year; (

c) approve the construction of a new Hammonds Plains South Elementary/Middle School for the Halifax Regional School Board, scheduled for completion for September 2005, at a total cost not to exceed $15,000,000, in accordance to the School Space Program set forth in

Schedule "B", attached to and forming part of the report and recommendation; (

d) approve the allocation of funding in the amount of $15,000,000 to cover costs of this project to be allocated in fiscal years 2003/04, 2004/05, 2005/06 and 2006/07; the total costs will subsequently be funded through the Tangible Capital Assets allocation of the Department of Education in subsequent years in the estimated amounts of $150,000 for the 2003/04 fiscal year, $6,925,000 for the 2004/05 fiscal year and $7,425,000 for the 2005/06 fiscal year and $500,000 for the 2006/07 fiscal year; (

e) approve the construction of a new Truro West Elementary School for the Chignecto-Central Regional School Board, scheduled for completion for September 2006, at a total cost not to exceed $7,000,000, in accordance to the School Space Program set forth in

Schedule "C", attached to and forming part of the report and recommendation; (

f) approve the allocation of funding in the amount of $7,000,000 to cover costs of this project to be allocated in fiscal years 2004/05, 2005/06, 2006/07 and 2007/08; the total costs will subsequently be funded through the Tangible Capital Assets allocation of the Department of Education in subsequent years in the estimated amounts of $50,000 for the 2004/05 fiscal year, $3,000,000 for the 2005/06 fiscal year, $3,800,000 for the 2006/07 fiscal year and $150,000 for the 2007/08 fiscal year; (

g) approve the construction of a new St. Patrick's/Queen Elizabeth High School for the Halifax Regional School Board, scheduled for completion for September 2006, at a total cost not to exceed $21,000,000, in accordance with the School Space Program set forth in

Schedule "D", attached to and forming part of the report and recommendation; (

h) approve the allocation of funding in the amount of $21,000,000 to cover costs of this project to be allocated in fiscal years 2004/05, 2005/06, 2006/07and 2007/08; the total costs will subsequently be funded through the Tangible Capital Assets allocation of the Department of Education in subsequent years in the estimated amounts of $1,000,000 for the 2004/05 fiscal year, $9,000,000 for the 2005/06 fiscal year, $10,500,000 for the 2006/07 fiscal year and $500,000 for the 2007/08 fiscal year; (

i) approve the construction of a new Harbourside/Robert Jamieson Elementary/Junior High School for the Halifax Regional School Board, at a total cost not to exceed $12,000,000, in accordance to the School Space Program set forth in

Schedule "E", attached to and forming part of the report and recommendation; (

j) approve the allocation of funding in the amount of $12,000,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

k) approve the construction of a new Musquodoboit Rural High School for the Halifax Regional School Board, at a total cost not to exceed $12,000,000, in accordance to the School Space Program set forth in

Schedule "F", attached to and forming part of the report and recommendation; (

l) approve the allocation of funding in the amount of $12,000,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

m) approve the construction of a new Glace Bay Junior High School for the Cape Breton-Victoria Regional School Board, at a total cost not to exceed $13,000,000, in accordance to the School Space Program set forth in

Schedule "G", attached to and forming part of the report and recommendation; (

n) approve the allocation of funding in the amount of $13,000,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

o) approve the construction of a new Northside Elementary Junior High School for the Cape Breton-Victoria Regional School Board, at a total cost not to exceed $16,000,000, in accordance to the School Space Program set forth in

Schedule "H", attached to and forming part of the report and recommendation; (

p) approve the allocation of funding in the amount of $16,000,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

q) approve the construction of a new Truro South Elementary School for the Chignecto-Central Regional School Board, at a total cost not to exceed $8,500,000, in accordance to the School Space Program set forth in

Schedule "I", attached to and forming part of the report and recommendation; (

r) approve the allocation of funding in the amount of $8,500,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

s) approve the construction of a new Stewiacke Elementary School for the Chignecto-Central Regional School Board, at a total cost not to exceed $8,000,000, in accordance to the School Space Program set forth in

Schedule "J", attached to and forming part of the report and recommendation; (

t) approve the allocation of funding in the amount of $8,000,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

u) approve the construction of a new Waverley/L.C. Skerry Elementary School for the Halifax Regional School Board, at a total cost not to exceed $7,500,000, in accordance to the School Space Program set forth in

Schedule "K", attached to and forming part of the report and recommendation; (

v) approve the allocation of funding in the amount of $7,500,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

w) approve the construction of a new Halifax South Elementary School for the Halifax Regional School Board, at a total cost not to exceed $10,000,000, in accordance to the School Space Program set forth in

Schedule "L", attached to and forming part of the report and recommendation; (

x) approve the allocation of funding in the amount of $10,000,000 to cover costs of this project; the Department of Education to determine the fiscal allocation in consultation with the Tangible Capital Assets Committee and return to Executive Council with a recommended fiscal plan and completion date for consideration and approval by Governor in Council; (

y) approve the Additions/Alterations projects and estimated costs to existing schools for school boards scheduled as set forth in

Schedule "M" attached to and forming part of the report and recommendation, at a total cost not to exceed $201,800,000; the funding allocation authorization for the Additions/Alterations to existing schools is subject to Governor in Council's annual approval of Additions/Alterations priority needs before expenditures are made; (

z) authorize the allocation of funding in the amount of $201,800,000 to cover costs of the Additions/Alterations to existing schools to be allocated in fiscal years 2003/04, 2004/05, 2005/06, 2006/07, 2007/08, 2008/09, 2009/10, 2010/11 and 2011/12; the total costs will be subsequently funded through the Tangible Capital Assets allocation of the Department of Education in subsequent years in the estimated amounts of $17,250,000 for fiscal year 2003/04, $18,500,000 for fiscal year 2004/05, $18,500,000 for fiscal year 2005/06, $18,500,000 for fiscal year 2006/07, $31,828,000 for fiscal year 2007/08, $36,050,000 for fiscal year 2008/09, $42,932,000 for fiscal year 2009/10, $15,772,000 for fiscal year 2010/11 and $2,468,000 for fiscal year 2011/12; (aa) approve the Additions/Alterations projects and costs for 2003/04 fiscal year as set out in

Schedule "N" attached to and forming part of the report and recommendation; (ab) approve a funding allocation for Additions/Alterations to existing schools of $17,250,000 for fiscal year 2003/04; (ac) authorize the allocation of funding in the amount of $141,500,000 to cover the costs of new school construction and $201,800,000 to cover the costs of Additions/Alterations to existing schools to be allocated in fiscal years 2003/04, 2004/05, 2005/06, 2006/07, 2007/08, 2008/09, 2009/10, 2010/11 and 2011/12 as set forth in

Schedule "O" attached to and forming part of the report and recommendation; (ad) authorize the Minister of Transportation and Public Works to do whatever is necessary to acquire the land and buildings for the new school construction and additions and alterations referred to in clauses (

a) to (ab) in the name of Her Majesty the Queen in Right of the Province of Nova Scotia, and authorize the Minister of Transportation and Public Works to tender for the necessary work to design and construct the buildings and acquire the equipment necessary for the school as approved; (ae) authorize the Minister of Transportation and Public Works to hold the buildings, equipment and land for the construction of the schools in clauses (

a) to (

x) and the Additions/Alterations projects to schools in clauses (

y) to (ab) in the name of Her Majesty the Queen in Right of the Province of Nova Scotia while the projects are in progress; (af) upon completion of the construction of the schools in clauses (

a) to (

x) and the Additions/Alterations projects to schools in clauses (

y) to (ab) to the satisfaction of the Minister of Transportation and Public Works and the Minister of Education, the buildings, equipment and land for the school shall be conveyed by Her Majesty the Queen in Right of the Province of Nova Scotia, as represented by the Minister of Transportation and Public Works, to the school boards referred to in clauses (

a) to (ab); and (ag) authorize the Minister of Education and the Minister of Transportation and Public Works to execute such instruments as may be necessary for the purpose of this Order and authorize both or either of them to enter into an agreement with the school boards referred to in clauses (

a) to (ab) to attain the purposes of this Order.
