B.C. Reg. 317/2008 , deposited November 7, 2008, pursuant to the EMPLOYMENT AND ASSISTANCE ACT [Section 35] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26]. Order in Council 807/2008, approved and ordered November 6, 2008.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective November 25, 2008,

(

a) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in sections 1 to 5 of the attached schedule, and

(

b) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in sections 6 to 10 of the attached schedule.

Schedule

EMPLOYMENT AND ASSISTANCE REGULATION

Section 1 (1) of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended by adding the following definition:

"nurse practitioner" has the same meaning as in the Nurses (Registered) and Nurse Practitioners Regulation; .

Section 73 (2) is amended by striking out "or" at the end of paragraph (

a) and by adding the following paragraph:

(a.1) a nurse practitioner, or .

Section 74 (

b) is amended by striking out "a medical practitioner confirms in writing" and substituting "a medical practitioner or nurse practitioner confirms in writing".

Section 75 (2) (

a) is amended by striking out "or by a registrant" and substituting ", a nurse practitioner or a registrant".

Schedule C is amended

(

a) in

section 2 (1) (a) (i) (

A) by striking out "a medical practitioner," and substituting "a medical practitioner or nurse practitioner," ,

(

b) in

section 2 (1) (c) (

i) by striking out "a medical practitioner" and substituting "a medical practitioner or nurse practitioner",

(

c) by repealing

section 2 (1) (f) (

i) and substituting the following:

(

i) an office, in the local area, of a medical practitioner or nurse practitioner,

(

d) in

section 2 (1) (f) (ii) by striking out "a local medical practitioner," and substituting "a local medical practitioner or nurse practitioner,",

(

e) by repealing

section 3 (1) (a) (

i) and (iii) and (d) (

i) and (ii),

(

f) by adding the following subsection to

section 3:

(2) In addition to the requirements of subsection (1) (

a) or (d), the minister must require one, and may require both, of the following:

(

a) a prescription of a medical practitioner or nurse practitioner for the wheelchair, personal motorized mobility device, cane, crutches, walker or positioning device;

(

b) an assessment by an occupational therapist or physical therapist confirming the need for the wheelchair, personal motorized mobility device, cane, crutches, walker or positioning device. ,

(

g) in

section 8 (2) by striking out "by a medical practitioner" and substituting "by a medical practitioner or nurse practitioner",

(

h) in

section 9 (b) (

i) by striking out "or by a registrant" and substituting ", a nurse practitioner or a registrant", and

(

i) in

section 10 (

a) by striking out "a medical practitioner" and substituting "a medical practitioner or nurse practitioner".

WITH DISABILITIES REGULATION

Section 1 (1) of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended by adding the following definition:
