Section 2 of the Crown Construction Contracts Act,

chapter 105 of the Revised Statutes, 2014, is repealed and the following is substituted: 1 L’article 2 de la

Machinery rental rates Tarifs de location des machines 2.2(1) With the approval of the Board of Management, the Minister of Transportation and Infrastructure may prescribe machinery rental rates. 2.2(1) Avec l’approbation du Conseil de gestion, le ministre des Transports et de l’Infrastructure peut fixer les tarifs de location des machines. 2.2(2) The Minister of Transportation and Infrastruc- ture shall cause the machinery rental rates to be made available to the public in the form and the manner that he or she considers appropriate. 2.2(2) Le ministre des Transports et de l’Infrastructure rend publics les tarifs sous la forme et selon le mode qu’il estime indiqués. 2.2(3) The Regulations Act does not apply to the ma- chinery rental rates. 2.2(3) La

2.2(5) When equipment is rented on an operated basis, the operator’s wages, calculated in the manner prescri- bed by regulation, shall be added to the rental cost. 2.2(5) Dans le cas où le matériel est loué avec conduc- teur, le salaire de ce dernier, calculé selon le mode de calcul prévu par règlement, est ajouté aux coûts de loca- tion. 2.2(6) In case of an emergency which endangers the health or safety of the public, the Crown may negotiate a machinery rental rate necessary to carry out the work. 2.2(6) En cas d’urgence menaçant la santé ou la sécu- rité publiques, la Couronne peut négocier des tarifs qui permettront l’exécution des travaux. 3 The Act is amended by adding after

section applies to performance bonds and payment bonds furnished to the Crown in relation to a contract administered on behalf of the Crown by the Minister of Transportation and Infrastructure. 7.1(1) Le présent

article s’applique aux cautionne- ments d’exécution et de paiement fournis à la Couronne par rapport à tout contrat qu’administre le ministre des Transports et de l’Infrastructure pour le compte de la Couronne. 7.1(2) The Minister of Transportation and Infrastruc- ture may prescribe standard terms and conditions not in- consistent with this Act or the regulations that are to be included in performance bonds and payment bonds. 7.1(2) Le ministre des Transports et de l’Infrastructure peut préciser des modalités et des conditions types com- patibles avec la présente loi et ses règlements et à inclure dans les cautionnements d’exécution et de paiement. 7.1(3) The standard terms and conditions may vary ac- cording to the type of bond or the class of the contract to which the bond relates. 7.1(3) Les modalités et les conditions types peuvent varier selon le type de cautionnement ou la catégorie de contrat auquel se rapporte le cautionnement. 7.1(4) The Minister of Transportation and Infrastruc- ture shall, on behalf of the Crown, refuse to accept any performance bond or payment bond that does not include the standard terms and conditions. 7.1(4) Le ministre des Transports et de l’Infrastructure doit, pour le compte de la Couronne, refuser d’accepter tout cautionnement d’exécution ou de paiement qui ne comporte pas les modalités et les conditions types. 7.1(5) The Minister of Transportation and Infrastruc- ture shall cause the standard terms and conditions to be made available to the public in the form and the manner that he or she considers appropriate. 7.1(5) Le ministre des Transports et de l’Infrastructure rend publiques les modalités et les conditions types sous la forme et selon le mode qu’il estime indiqués. 7.1(6) The Regulations Act does not apply to the standard terms and conditions. 7.1(6) La

Section 8 of the Act is amended 4 L’article 8 de la Loi est modifié (

a) by adding after paragraph (

e) the following:

(e.3) respecting the negotiation of contracts follow- ing a tender opening; e.3) prendre des mesures concernant la négociation de contrats à la suite de l’ouverture des soumissions; (e.4) prescribing the manner of calculating an oper- ator’s wages for the purposes of subsection 2.2(5); e.4) prévoir le mode de calcul du salaire du conduc- teur aux fins de l’application du paragraphe 2.2(5); (

b) by repealing paragraph (f);

c) by repealing paragraph (g).
