Section 1 of the Public Works Act,

chapter 108 of the Revised Statutes, 2016, is amended by repealing the definition “public work” and substituting the follow ‐ ing: 1 L’article 1 de la

Loi sur les travaux publics, chapi ‐ tre 108 des Lois révisées de 2016, est modifié par l’abrogation de la définition d’« ouvrage public » et son remplacement par ce qui suit : “public work” means all lands, buildings and other structures « ouvrage public » S’entend de tous les biens-fonds et de tous les bâtiments ou autres constructions : (

a) belonging to the Crown in right of the Province except

a) qui appartiennent à la Couronne du chef de la province, à l’exclusion : (

i) the lands, buildings or other structures that are under the administration of a minister, other than the Minister, or under the administration of another agent of the Crown in right of the Province by an ‐ other Act, (

c) of the definition “public work”, the Minister may designate lands, build ‐ ings or other structures as public works in the following circumstances: 1.1 Aux fins d’application de l’alinéa c ) de la défini ‐ tion d’« ouvrage public », le ministre peut désigner ou ‐ vrages publics des biens-fonds et des bâtiments ou autres constructions dans les situations suivantes : (

a) the effective date of transfer of the land, build ‐ ing or other structure has been established; and

b) the approval of the Lieutenant-Governor in Council has been obtained.

Section 26 of the Act is amended 3 L’article 26 de la Loi est modifié (

a) in subsection (1) by striking out “$15,000” and substituting “$95,000”;

Section 30.1 of the Act is amended by adding after subsection (1) the following: 5 L’article 30.1 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (1) : 30.1(1.1) The Minister may sell or otherwise dispose of vacant land referred to in subsection (1) through the Surplus Property – Open to Offers link under the Surplus Property for Sale

Section 31 of the Act is repealed and the following is substituted: 6 L’article 31 de la Loi est abrogé et remplacé par ce qui suit : 31(1) If the Minister sells public works under

section 26 or 30.1, the Minister shall provide to Executive Council a report on all such sales occurring in the fiscal year in the form approved by Executive Council within six months after the end of each fiscal year. 31(1) Le ministre qui vend un ouvrage public tel que le prévoit l’article 26 ou 30.1 fournit au Conseil exécutif, en la forme que celui-ci approuve, un rapport sur toutes ces ventes effectuées au cours de l’exercice financier, et ce, dans les six mois qui suivent la fin de chaque exer ‐ cice financier. 31(2) A report under subsection (1) shall be published in the Royal Gazette within one month after the report is accepted by Executive Council. 31(2) Le rapport prévu au paragraphe (1) paraît dans la Gazette royale un mois au plus tard après que le Con ‐ seil exécutif l’accepte. 7

a) by renumbering the

section as subsection 34(1);
