B.C. Reg. 215/2017 , deposited November 28, 2017, under the HOME OWNER GRANT ACT [section 18] and the MANUFACTURED HOME ACT [section 40]. Order in Council 444/2017, approved and ordered November 28, 2017.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that
(
a) effective January 1, 2017, the Home Owner Grant Regulation, B.C. Reg. 100/2002, is amended as set out in the attached
Schedule 1, and
(
b) the Manufactured Home Regulation, B.C. Reg. 441/2003, is amended as set out in the attached
Schedule 2.

Schedule 1
Section 3 of the Home Owner Grant Regulation, B.C. Reg. 100/2002, is repealed and the following substituted:
Tax notice – application form
3 An application for a grant, in the form approved by the minister, must be included with the tax notice.
Section 5 is repealed and the following substituted:
Multiple residence property – application requirements
5 An application for a grant in respect of property described in
section 3, 4 or 5 of the Act must be accompanied by an eligible occupant application, in the form approved by the minister, completed by each eligible occupant of the property.
Part 1 is amended by adding the following section:
Extension of time
8.2 The date before which a collector in a municipality must deliver to the Minister of Finance a final certified statement referred to in
section 12 (2) of the Act is extended from before February 28 of each year to on or before the fifth business day in March of each year.
Schedule 2
Section 16 (3) of the Manufactured Home Regulation, B.C. Reg. 441/2003, is repealed and the following substituted:
(3) Interest on a deposit must be paid or credited by the taxing authority as follows:
(
a) in a municipality other than the City of Vancouver, at the rate prescribed under
section 239 (2) of the Community Charter from the date of payment to the first tax penalty date stated in, or established by, a bylaw under
section 234 or 235 of the Community Charter ;
(
b) in the City of Vancouver, at the rate stated in, or established by, a bylaw under
section 412 of the Vancouver Charter ;
(
c) in a rural area, at the rate and by the method prescribed under
section 13 (1) of the Taxation (Rural Area) Act .
Section 17 is repealed and the following substituted:
Receipt for deposit
17 If a deposit has been paid to a collector under
section 26 (1) (
d) of the Act, the
collector must issue a receipt for the payment and include with the receipt an application
for a grant under the Home Owner Grant Act in the form prescribed under that Act.
