Definition

1 In this regulation, " Act " means The Consumer Protection Act .

Bodies designated as government agencies

2 The following bodies are designated as a government agency for the purposes of

Part XIX (Government Cheque Cashing Fees) of the Act:

(

a) The Manitoba Housing Authority;

(

b) The Manitoba Housing and Renewal Corporation;

(

c) The Manitoba Public Insurance Corporation;

(

d) The Workers Compensation Board;

(

e) Manitoba Hydro.

Provision for which administrative penalty may be issued

3 A notice of administrative penalty may be issued under subsection 136(1) of the Act if a person fails to comply with

section 166 of the Act.

Administrative penalty amounts

4(1) The amount of an administrative penalty to be imposed on an individual is as follows:

(

a) first contravention

$1,000;

(

b) second contravention

$3,000;

(

c) third or subsequent contravention

$5,000.

4(1) Le montant d'une sanction administrative imposée à une personne physique est déterminé comme suit :

a) première contravention

4(2) The amount of an administrative penalty to be imposed on a corporation is as follows:

(

a) first contravention

$5,000;

(

b) second contravention

$10,000;

$20,000.

Form for the notice of administrative penalty

5 A notice of administrative penalty must be in Form 1 of the Schedule.

Coming into force

6(1) Subject to subsection (2), this regulation comes into force on the same day that

section 165 of the Act, as enacted by

section 2 of The Consumer Protection Amendment Act (Government Cheque Cashing Fees) , S.M. 2006, c. 17, comes into force, or on the day that it is registered under The Regulations Act , whichever is later.

6(1)

Sous réserve du paragraphe (2), le présent règlement entre en vigueur en même temps que l'article 165 de la Loi , édicté par l'article 2 de la Loi modifiant la

Loi sur la protection du consommateur (frais d'encaissement des chèques du gouvernement) , c. 17 des L.M. 2006 , ou à la date de son enregistrement sous le régime de la

Loi sur les textes réglementaires , si cette date est postérieure.

6(2) Sections 3 to 5 come into force on the same day that

section 166 of the Act, as enacted by

section 2 of The Consumer Protection Amendment Act (Government Cheque Cashing Fees) , S.M. 2006, c. 17, comes into force.

6(2) Les articles 3 à 5 entrent en vigueur en même temps que l'article 166 de la Loi , édicté par l'article 2 de la Loi modifiant la
