B.C. Reg. 419/2008 , deposited December 12, 2008, pursuant to the HEALTH PROFESSIONS ACT [Section 12]; HEALTH PROFESSIONS AMENDMENT ACT (No. 2), 2003 [Section 13]; PHARMACY OPERATIONS AND DRUG SCHEDULING ACT [Section 67]; HEALTH STATUTES AMENDMENT ACT, 2006 [Section 37]; E-HEALTH (PERSONAL HEALTH INFORMATION ACCESS AND PROTECTION OF PRIVACY) ACT [Section 47]; HEALTH STATUTES AMENDMENT ACT, 2007 [Section 40]; COMMUNITY CARE AND ASSISTED LIVING ACT [Section 34]; FISHERIES ACT [Section 26];and the PHARMACISTS, PHARMACY OPERATIONS AND DRUG SCHEDULING ACT [Section 1]. Order in Council 970/2008, approved and ordered December 12, 2008.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that effective April 1, 2009:

1 The Health Professions Amendment Act (No. 2), 2003 , S.B.C. 2003, c. 73, except

section 12, is brought into force.

2 The Pharmacy Operations and Drug Scheduling Act , S.B.C. 2003, c. 77, is brought into force.

Section 7 of the Health Statutes Amendment Act, 2006 , S.B.C. 2006, c. 23, insofar as it enacts

section 15.1 (4) of the Health Professions Act , is brought into force.

4 Sections 43 (a), 44 and 46 of the E-Health (Personal Health Information Access and Protection of Privacy) Act , S.B.C. 2008, c. 38, are brought into force.

5 The following sections of the Health Statutes Amendment Act, 2007 , S.B.C. 2007, c. 19, are brought into force:

(

a) section 29 (a);

(

b) section 29 (b), as re-enacted by the E-Health (Personal Health Information Access and Protection of Privacy) Act , S.B.C. 2008, c. 38, s. 37;

(

c) section 30, as re-enacted by the E-Health (Personal Health Information Access and Protection of Privacy) Act , S.B.C. 2008, c. 38, s. 38;

(

d) section 31;

(

e) section 32, insofar as it enacts

section 13.1 (1) and (2) of the Pharmacy Operations and Drug Scheduling Act ;

(

f) sections 33, 34 (a), 35 (

a) and 36.

6 The amendments set out in the attached Appendix are made

Appendix

Community Care and Assisted Living Act

1 The Adult Care Regulation, B.C. Reg. 536/80, is amended

(

a) in

section 8 by striking out " Pharmacists, Pharmacy Operations and Drug Scheduling Act "in both places and substituting " Pharmacy Operations and Drug Scheduling Act ", and

(

b) in

section 8.2 (2) (

a) by striking out " Pharmacists, Pharmacy Operation and Drug Scheduling Act "and substituting " Pharmacy Operations and Drug Scheduling Act ".

Section 5 of the Assisted Living Regulation, B.C. Reg. 218/2004, is amended by striking out " Pharmacists, Pharmacy Operations and Drug Scheduling Act "and substituting " Pharmacy Operations and Drug Scheduling Act ".

Fisheries Act

3 The definition of "drug" in

section 1 of the Aquaculture Regulation, B.C. Reg. 78/2002, is amended by striking out " Pharmacists, Pharmacy Operations and Drug Scheduling Act "and substituting " Pharmacy Operations and Drug Scheduling Act ".

Health Professions Act

Section 2 (3) of the Health Professions Designation Regulation, B.C. Reg. 270/2008, is amended by adding the following:

(

d) the practice of pharmacy; .

Pharmacists, Pharmacy Operations and Drug Scheduling Act

5 The Prescribed Health Care Profession Regulation, B.C. Reg. 277/97, is repealed.
