Malignant Cove Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-971 (August 17, 1976), N.S. Reg. 140/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 27th day of July, A.D., 1976, pursuant to

Section 5(1) of

Chapter 6 of the

Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to designate as a beach an area of land lying landward from the mean high watermark of

Malignant Cove Beach, in the County of Antigonish, Province of Nova Scotia, as shown

outlined in red on the copy of Crown Land Records Office Plan No. E-7-67, marked

Schedule

“B” and described in

Schedule “A”, both attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high watermark of Malignant Cove

Beach, in the County of Antigonish, Province of Nova Scotia as shown outlined in red on the

copy of Crown Land Records Office Plan No. E-7-67, attached hereto and marked

“B” and being more particularly described as follows:

Beginning at iron post “A” as shown on said Plan E-7-67, said iron post being situated on the

high waterline of Malignant Cove;

From thence (by astronomic bearings) south sixty-seven degrees thirteen minutes thirty-four

seconds east, fifty decimal zero feet to iron post “B”;

Thence in a southerly, northwesterly and westerly direction along an irregular line being

parallel to and equidistant fifty feet inland from the high waterline of Malignant Cove to iron

post “C”, said post being south seventy degrees five minutes fifty-six seconds west, nine

thousand seven hundred forty decimal zero feet from the aforementioned iron post “B”;

Thence north fifteen degrees thirty-three minutes five seconds west, one hundred twenty

decimal thirty feet to iron post “D” situated on the high waterline of Malignant Cove;

Thence north seventy degrees thirty-six minutes fifty-six seconds east, nine thousand six

hundred ninety-four decimal fifty-two feet to the place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high watermark.
