OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal dated August 23, 2013, and pursuant to

Section 11 of

Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to: (

a) authorize the disposal, by means of the granting of an Option to purchase, of certain lands containing an area of 4,564 square feet, more or less, situate at or near Lower Water Street, County of Halifax, and more particularly described in

Schedule "A" and identified as Parcel "5" on

Schedule "B", which Schedules are attached to and form part of the Report and Recommendation; (

b) authorize the conveyance of the said lands to Summer Wind Partners II Limited and 3127091 Nova Scotia Limited at the market value, based on highest and best use, established at the time of the exercise of the Option, and on such other terms and conditions as set out in an Option Agreement to be entered in by the Province, Summer Winds Partners II Limited and 3127091 Nova Scotia Limited; and (

c) authorize the Minister of Transportation and Infrastructure Renewal to make and execute an Option Agreement and a deed of conveyance on such terms and in such form as the Minister determines to effect the conveyance of the lands herein above described.
