Motor-driven Cycles Regulations

made under

Section 10 of the

Motor Vehicle Act

R.S.N.S. 1989, c. 293

as amended by O.I.C. 86-886 (July 22, 1986), N.S. Reg. 187/86

1 In these regulations "motor-driven cycle" means a motor vehicle

(

i) having two tandem wheels each with a rim diameter greater than

10 inches,

(ii) having steering handlebars completely constrained from rotating

in relation to the axle of one wheel in contact with the ground,

(iii) with a wheelbase greater than 40 inches,

(iv) with a seat height unladen greater than 28 inches above the level

surface on which the vehicle stands,

(

v) having an engine not capable of developing more than 5 brake

horsepower as measured at the driveshaft,

(vi) not capable of maintaining a speed of 40 miles per hour when

laden.

Clause 1(

2 There is a class of vehicle designated and known as a motor-driven cycle.

3 The registration fee for a registration year for a motor-driven cycle is as

provided in the

schedule of fees approved under

Section 270 [Section 302] of

the Motor Vehicle Act.

4 The means of identification and proof of registration of a motor-driven cycle in

respect of which the registration fee has been paid for a full registration year

shall be a serially numbered sticker issued by the Registrar of Motor Vehicles

for that registration year.

5 The sticker mentioned in

Section 4 shall be affixed to and displayed

(

a) on a number plate bearing the words "Nova Scotia" at the top;

(

b) in the area and in the position on the number plate as may be from

time to time prescribed by the Registrar of Motor Vehicles.

6 On payment of the prescribed registration fee for a registration year, the

registered owner of the motor-driven cycle shall be issued with a sticker for the

number plate issued in respect of the motor-driven cycle.

7 Except as permitted by

Section 62 [Section 70] of the Motor Vehicle Act, no

person shall drive a motor-driven cycle on a highway unless he holds a drivers

license that contains a condition permitting the holder to drive a motorcycle.

8 No person shall drive a motor-driven cycle on a highway unless he wears a

safety helmet that meets the standards specified in any of the standards

mentioned in the Motor Cycle Safety Helmet Regulations which were made by

the Governor in Council on June 23, 1971, and were amended by the Governor

in Council on December 21, 1971 [and on December 4, 1979].

(1) It is an offence for an operator of a motor-driven cycle to support, carry or

in any way transport another person on a motor-driven cycle.

(2) Without restricting the generality of subsection (1), it is an offence for the

operator of a motor-driven cycle to carry another person on the handlebar

frame or other part of a motor-driven cycle, or upon the person of the

operator or for any person to so ride upon a motor-driven cycle.

(1) It is an offence for an operator of a motor-driven cycle to allow the same

to proceed on a highway by inertia momentum with his feet removed from

the pedals nor shall such operator remove both hands from the handlebars

while riding the motor-driven cycle nor practice any tricks or fancy riding

on a highway.

(2) No person shall ride a motor-driven cycle on a sidewalk.

(3) No person shall ride a motor-driven cycle on a highway except as near as

practicable to the extreme right of the main travelled portion of the

highway and no person shall ride a motor-driven cycle abreast of or

generally parallel to another motor-driven cycle in motion on the highway

except for the purpose of passing any such other motor-driven cycle.
