Section 1 of the Saint John Transit Commission Act,

chapter 81 of the Acts of New Brunswick, 1979, is amended 1 L’article 1 de la

a) in the English version by repealing the defini- tion “Chairman” and substituting the following:

b) by repealing the definition “general manager”.

Section 5 of the Act is amended by repealing para- graph (

c) the election of the Chair and the appointment of the secretary and other officers of the Commission and the conduct and duties of officers and employees;

Section 6 of the Act is amended by adding after subsection (4) the following: 6 L’article 6 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (4): 6(4.1) The Commission shall ensure that operations in each fiscal year comply with the approved operating budget as adjusted under subsections (3) and (4). 6(4.1) La Commission doit veiller à ce que les opéra- tions au cours de chaque exercice financier soient con- formes au budget d’exploitation approuvé et rajusté conformément aux paragraphes (3) et (4). 7 The Act is amended by adding after

section 9 the following: 7 La Loi est modifiée par l’adjonction de ce qui suit après l’article 9 : DIRECTIVES DIRECTIVES 10(1) The Council may issue directives that must be followed by the Commission in carrying out its powers and duties under this Act. 10(1) Le Conseil peut donner des directives que la Commission doit suivre dans l’exercice de ses attribu- tions et fonctions prévues dans la présente loi. 10(2) The Commission shall ensure that any directive issued to the Commission is implemented in a prompt and efficient manner. 10(2) La Commission veille à ce que les directives qui lui sont données soient appliquées promptement et effi- cacement. 10(3) Compliance by the Commission with any direc- tive shall be deemed to be compliance with any duties that may arise under this Act, including the duty to act in the best interests of the Commission. 10(3) Le respect par la Commission d’une directive quelconque est réputé correspondre au respect des fonc- tions pouvant découler de la présente loi, y compris de l’obligation d’agir dans le meilleur intérêt de la Commis- sion.

PENSION PLAN INELIGIBILITY INADMISSIBILITÉ AU RÉGIME DE RETRAITE 11 Despite the provisions of the Pension Benefits Act or any regulations made under that Act, or any other Act or regulation, or any agreement, memorandum of under- standing, contract, trust agreement, pension plan or other instrument, employees of the Commission are not em- ployees of the City for any purpose and, for greater cer- tainty, are not eligible to participate in The City of Saint John Shared Risk Plan. 11

WINDING UP LIQUIDATION 12(1) Subject to the approval of the Lieutenant- Governor in Council, and despite the provisions of the Companies Act and the Winding-up Act, the Council may by resolution direct the winding-up and dissolution of the Commission. 12(1)

9 The Common Council of The City of Saint John shall appoint not more than seven members to the Saint John Transit Commission in accordance with subsection 2(5) of the Saint John Transit Commission Act effective on the commencement of this Act. 9 Le Conseil municipal de la cité appelée The City of Saint John désigne au plus sept membres de la Com- mission des transports de Saint-Jean conformément au paragraphe 2(5) de la
