B.C. Reg. 412/2008 , deposited December 12, 2008, pursuant to the HEALTH PROFESSIONS ACT [Section 12]; HEALTH PLANNING STATUTES AMENDMENT ACT, 2002 [Section 29]; HEARING AID ACT [Section 23]; BONDING ACT [Section 11]; EMPLOYMENT AND ASSISTANCE ACT [Section 35]; EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26]; HEALTH CARE (CONSENT) AND CARE FACILITY (ADMISSION) ACT [Sections 1 and 34]. Order in Council 965/2008, approved and ordered December 11, 2008.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders the following:

1 Effective April 1, 2010, sections 16 and 27 of the Health Planning Statutes Amendment Act, 2002, S.B.C. 2002, c. 15, are brought into force.

2 Effective December 15, 2008,

section 2 of the Health Professions Designation Regulation, B.C. Reg. 270/2008, is amended by adding the following:

(3) The following professions are designated for the purposes of the Act:

(

a) audiology, hearing instrument dispensing and speech-language pathology; .

3 Effective April 1, 2010, the amendments set out in the attached Appendix are made.

Appendix

Bonding Act

1 The Bonding Regulations, B.C. Reg. 11/68, are amended

(

a) by repealing Division 7, and

(

b) in the

Schedule by repealing the form of bond in respect of the Hearing Aid Act .

Employment and Assistance Act

Schedule C of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended

(

a) in

section 1 by adding the following definition:

"audiologist" means an audiologist registered with the College of Speech and Hearing Health Professionals of British Columbia established under the Health Professions Act ; ,

(

b) in

section 1 by striking out the definition of "hearing aid dealer and consultant" and substituting the following:

"hearing instrument practitioner" means a hearing instrument practitioner registered with the College of Speech and Hearing Health Professionals of British Columbia established under the Health Professions Act ; ,

(

c) in

section 3 (1) (

c) by striking out "hearing aids" and substituting "hearing instruments",

(

d) in

section 3 (1) (

c) by striking out "hearing aid dealer and consultant" in both places and substituting "hearing instrument practitioner", and

(

e) in

section 3 (1) (c) (iii) by striking out "hearing aid" and substituting "hearing instrument".

Employment and Assistance for Persons with Disabilities Act

Schedule C of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(

a) in

section 1 by adding the following definition:

"audiologist" means an audiologist registered with the College of Speech and Hearing Health Professionals of British Columbia established under the Health Professions Act ; ,

(

b) in

section 1 by striking out the definition of "hearing aid dealer and consultant" and substituting the following:

"hearing instrument practitioner" means a hearing instrument practitioner registered with the College of Speech and Hearing Health Professionals of British Columbia established under the Health Professions Act ; ,

(

c) in

section 3 (1) (

c) by striking out "hearing aids" and substituting "hearing instruments",

(

d) in

section 3 (1) (

c) by striking out "hearing aid dealer and consultant" in both places and substituting "hearing instrument practitioner", and

(

e) in

section 3 (1) (c) (iii) by striking out "hearing aid" and substituting "hearing instrument".

Health Care (Consent) and Care Facility (Admission) Act

Section 3 of the Health Care Consent Regulation, B.C. Reg. 20/2000, is amended by repealing paragraph (d).

Hearing Aid Act

5 The Hearing Aid Act Fee Regulation, B.C. Reg. 107/97, is repealed.
