B.C. Reg. 111/2011 , deposited June 17, 2011, pursuant to the ADULT GUARDIANSHIP AND PLANNING STATUTES AMENDMENT ACT, 2007 [section 112], the MISCELLANEOUS STATUTES AMENDMENT ACT, 2011 [section 36], the POWER OF ATTORNEY ACT [section 41 (2) (

b) and (

c) and (4)] and the REPRESENTATION AGREEMENT ACT [section 42 (2) and (4)]. Order in Council 242/2011, approved and ordered June 16, 2011.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

Section 1 (b) (ii) and (iv) of B.C. Reg. 14/2011 is repealed and the following substituted:

(ii) sections 1 (

b) and (c), 4, 5, 18, 31 (b), 33, 60 (b), 61 (a), 67, 73, 82, 94 to 97, 100 to 103 and 110 (

b) and (c),

(iv)

section 17 as it enacts sections 62, 62.1, 62.2 (2), 62.3 and 63 (2) (

a) to (

s) and (3) to (6) of the Adult Guardianship Act , .

2 Sections 1 to 15, 26 and 27 of the Miscellaneous Statutes Amendment Act, 2011, S.B.C. 2011, c. 5, are brought into force.

3 Effective September 1, 2011, sections 22 to 25 and 28 to 32 of the Miscellaneous Statutes Amendment Act, 2011, S.B.C. 2011, c. 5, are brought into force.

4 Effective September 1, 2011, the Power of Attorney Regulation, B.C. Reg. 20/2011, is amended

(

a) in

section 2 (1) and (2) by adding " acting under an enduring power of attorney " after " An attorney ", and

(

b) in

section 5 (

b) by striking out " continue to act " and substituting " act, or continue to act, ".

5 Effective September 1, 2011, the

Schedule to the Representation Agreement Regulation, B.C. Reg. 199/2001, as amended by B.C. Reg. 21/2011, is amended as set out in the attached Appendix.

Appendix

Section 1 of

Part 2 of Form 1 [Certificate of Representative or Alternate Representative] of the

Schedule to the Representation Agreement Regulation, B.C. Reg. 199/2001, as amended by B.C. Reg. 21/2011, is amended

(

a) in paragraph (

b) by adding " or I do provide the services described in this paragraph, but I am a child, parent or spouse of the adult, " after " representation agreement, ", and

(

b) in paragraph (

c) by adding " or I am an employee described in this paragraph, but I am a child, parent or spouse of the adult, " after " health care services, ".

2 Form 4 [Certificate of Witnesses] is amended

(

a) in

section 4 (

e) of

Part 1 and 4 (

f) of

Part 2 by striking out " [does not apply to an employee or agent of the Public Guardian and Trustee, or a trust company or credit union] " and substituting " [does not apply to an employee or agent of the Public Guardian and Trustee, a lawyer, a member in good standing of the Society of Notaries Public of British Columbia, a trust company or a credit union] ", and

(

b) in

Part 2 by striking out " practising member of the Law Society of British Columbia or a member " and substituting " lawyer or a member in good standing ".
