B.C. Reg. 340/2005, deposited November 25, 2005, pursuant to the WILDLIFE ACT [Section 108]. Order in Council 837/2005, approved and ordered November 24, 2005.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Designation and Exemption Regulation, B.C. Reg. 168/90, is amended as set out in the attached Appendix 1,

(

b) the Firearm and Hunting Licensing Regulation, B.C. Reg. 8/99, is amended as set out in the attached Appendix 2,

(

c) the Hunter Safety Training Regulation, B.C. Reg. 53/98, is amended as set out in the attached Appendix 3,

(

d) the Limited Entry Hunting Regulation, B.C. Reg. 134/93, is amended as set out in the attached Appendix 4,

(

e) the Wildlife Act Commercial Activities Regulation, B.C. Reg. 338/82, is amended as set out in the attached Appendix 5, and

(

f) the Wildlife Act General Regulation, B.C. Reg. 340/82, is amended as set out in the attached Appendix 6.

Appendix 1

1 The Designation and Exemption Regulation, B.C. Reg. 168/90, is amended in

section 9 by striking out "from sections 11 (1) (

a) and (8)" and substituting "from sections 11 (1) and (8)",

Section 9.1 (1) is amended

(

a) by striking out "from

section 11 (1) (a)" and substituting "from

section 11 (1)", and

(

b) by striking out "carry a firearm or".

Section 11.2 (1) is amended by striking out "section 11 (1) (a)" and substituting "section 11 (1)".

Appendix 2

4 The Firearm and Hunting Licensing Regulation, B.C. Reg. 8/99, is amended in the title by striking out "FIREARM AND".

5 Sections 2, 3 and 4 are repealed.

Section 19 is amended by striking out "or firearm licence".

Section 23.1 (1), (3) and (4) are amended by striking out "from

section 11 (1) (b) (

i) and (ii)" and substituting "from

section 11 (1.1)".

8 The

Schedule is amended

(

a) by repealing

section 1,

(

b) by striking out "and to carry firearms" in

section 2 (a), (b), (

c) and (d), and

(

c) by striking out "except a firearm licence" in

section 6 (d).

Appendix 3

9 The Hunter Safety Training Regulation, B.C. Reg. 53/98, is amended in

section 6 (2) (a) (ii) by striking out "Firearm and Hunting Licensing Regulation" and substituting "Hunting Licensing Regulation".

Section 9 (3) is repealed and the following substituted:

(3) The director may order a person who has his or her hunting licence cancelled, or who has been prohibited from hunting, to successfully complete the CORE program before that person may again obtain a hunting licence or hunt.

Appendix 4

11 The Limited Entry Hunting Regulation, B.C. Reg. 134/93, is amended in

section 4.1 (2) (

b) and (2.1) (

b) by striking out "Firearm and Hunting Licensing Regulation" and substituting "Hunting Licensing Regulation".

Appendix 5

12 The Wildlife Act Commercial Activities Regulation, B.C. Reg. 338/82, is amended by repealing

section 3.12.

Appendix 6

13 The Wildlife Act General Regulation, B.C. Reg. 340/82, is amended by repealing

section 7.02 (2).

Section 7.04 is amended

(

a) by repealing subsections (3) and (6) (c),

(

b) in subsection (4) by striking out "subsections (1) and (3)" and substituting "subsection (1)" and by striking out "or firearm",

(

c) in subsection (7) by striking out "or firearm", and

(

d) in the Table by deleting Column

Section 11.01 is repealed and the following substituted:

Residency exemptions

11.01 A person who

(

a) is a member of the armed services of Her Majesty raised by Canada and enrolled in continuing full time military service who has made his or her permanent residence in British Columbia for 30 consecutive days immediately before making an application under the Act or doing another thing relevant to the operation of the Act,

(

b) is a Canadian citizen or permanent resident of Canada, who leaves British Columbia to attend a recognized educational institution, and who returns to British Columbia on completion of studies at the institution concerned, or

(

c) is under 19 years of age, has resided with a parent or guardian in another province and returns to British Columbia to reside with another parent or guardian who is a resident,

is, for the purpose of qualifying as a resident, exempt from the requirements set out in paragraph (

a) of the definition of "resident" in

section 1 of the

Wildlife Act .
