MINISTERIAL ACCOUNTABILITY BASES, 2004-2005,

AMENDMENT ACT, 2005

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Section 1 of the Ministerial Accountability Bases Act, 2004-2005 , S.B.C. 2004, c. 50, is amended by striking out "

section 5 (1) and 6 (1) " and substituting " sections 5 (1) and 6 (1) ".

2 The following sections are added:

Minister of Forests

3 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Forests for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year,

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 2) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act, and

(

c) the amount of any expenses incurred by that minister for that fiscal year under the authority of

section 171 [appropriation for fire fighting] of the Forest Practices Code of British Columbia Act .

Minister of Agriculture, Food and Fisheries

4 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Agriculture, Food and Fisheries for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year, and

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 3) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act.

Minister of Energy and Mines

5 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Energy and Mines for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year,

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 4) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act, and

(

c) the amount of any expenses incurred by that minister for that fiscal year under the authority of

section 13 [appropriation for grants under the Act] of the Northern Development Initiative Trust Act .

Minister of Transportation

6 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Transportation for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year,

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 5) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act, and

(

c) the amount of any expenses incurred by that minister for that fiscal year under the authority of

section 13 [appropriation for grants under the Act] of the Northern Development Initiative Trust Act .

Minister of Community, Aboriginal and Women's Services

7 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Community, Aboriginal and Women's Services for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year,

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 7) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act,

(

c) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 10) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act, and

(

d) the amount of any expenses incurred by that minister for that fiscal year under the authority of

section 13 [appropriation for grants under the Act] of the Northern Development Initiative Trust Act .

Minister of Advanced Education

8 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Advanced Education for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year, and

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 8) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act.

Minister of Small Business and Economic Development

9 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Small Business and Economic Development for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year,

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 9) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act,

(

c) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 10) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act,

(

d) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 11) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act, and

(

e) the amount of any expenses incurred by that minister for that fiscal year under the authority of

section 13 [appropriation for grants under the Act] of the Northern Development Initiative Trust Act .

Minister of Human Resources

10 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Human Resources for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year, and

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 11) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act.

Minister of Public Safety and Solicitor General

11 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Public Safety and Solicitor General for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year,

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 11) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act, and

(

c) the amount of any expenses incurred by that minister for that fiscal year under

section 16 [appropriation for emergency plan or emergency measures] of the Emergency Program Act .

Minister of Sustainable Resource Management

12 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Sustainable Resource Management for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year, and

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 11) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act.

Minister of Water, Land and Air Protection

13 For the purposes of sections 5 (1) and 6 (1) of the Balanced Budget and Ministerial Accountability Act in relation to the Minister of Water, Land and Air Protection for the 2004-2005 fiscal year, the estimated amount under

section 6 (1) of that Act is the sum of

(

a) the amounts appropriated for the operating expenses for which that minister is responsible in the main estimates for that fiscal year, and

(

b) the amount appropriated under

section 1 of the Supply Act, 2004-2005 (Supplementary Estimates No. 11) for the operating expenses for which that minister is responsible in the supplementary estimates referred to in the

preamble to that Act.

Commencement

3 This Act comes into force on the date of Royal Assent.
