I, George Heyman, Minister of Environment and Climate Change Strategy, order that

(

a) the Code of Practice for Soil Amendments, B.C. Reg. 210/2007, is amended as

set out in the attached

Schedule 1, and

(

b) the Contaminated Sites Regulation, B.C. Reg. 375/96, is amended as set out

in the attached

Schedule 2.

Schedule 1

Section 9 of the Code of Practice for Soil Amendments, B.C. Reg. 210/2007, is

amended

(

a) in subsection (1) by repealing the definition of “medical health officer” and substituting the following:

“medical health officer” , in relation to land, means a medical health officer within the meaning of the Public Health Act who has jurisdiction within the geographic area in which the land is located; , and

(

b) in subsections (2) (b), (4) (a), (6) and (7) by striking out “ the medical health officer ” and substituting “ a medical health officer ”.

Schedule 2

Section 1 of the Contaminated Sites Regulation, B.C. Reg. 375/96, is amended by repealing the

definitions of “medical health officer” and “Provincial health officer” and substituting the following:

“medical health officer” , in relation to a contaminated site, means a medical health officer within the meaning of the Public Health Act who has jurisdiction within the geographic area in which the contaminated site is located;

“provincial health officer” means the provincial health officer appointed under the Public Health Act ; .

Section 18 is amended by striking out “ the local medical health officer ” wherever it appears and substituting “ a medical health officer ”.

Section 18.1 is amended

(

a) by striking out “ the medical health officer ” wherever it appears and substituting “ a medical health officer ”, and

(

b) in subsections (1) (

c) and (3) by striking out “ the Provincial health officer ” and substituting “ the provincial health officer ”.
