Fair Trading Act

GENERAL LICENSING AND SECURITY AMENDMENT REGULATION

section 139 of the Fair Trading Act.

1 The General Licensing and Security Regulation

(AR 187/99) is amended by this Regulation.

Section 5 is amended by renumbering it as 5(1) and

adding the following after subsection (1):

(2) The Director may refund a licensing fee on a pro rata basis based

on the number of full years remaining on a multi-year licence if

(

a) the Director is satisfied that the licensee has ceased carrying

on licensed activities, and

(

b) the licensee requests in writing that the Director cancel the

licence.

Section 12(d.1) is amended by striking out "or" at the end

of subclause (iv), adding ", or" at the end of subclause (

v) and adding the following after subclause (v):

(vi) a borrower who borrows a payday loan from a payday lender;

Section 23(1) is amended by striking out "and" at the end

of clause (a), adding ", or" at the end of clause (

b) and

adding the following after clause (b):

(

c) the claim is not based on the cancellation of a travel club

contract under

section 13, 14 or 15 of the Travel Clubs

Regulation.

5 This Regulation comes into force on September 1, 2009.

INTERNET SALES CONTRACT AMENDMENT REGULATION

section 42 of the Fair Trading Act.

1 The Internet Sales Contract Amendment Regulation

(AR 81/2001) is amended by this Regulation.

Section 3 is amended by adding the following after

clause (q):

(

r) the activity of offering, arranging or providing payday loans

as defined in the Payday Loans Regulation by a person who

is licensed under that Regulation.

3 This Regulation comes into force on September 1, 2009.

School Act

PRIVATE SCHOOLS AMENDMENT REGULATION

For information only: Made by the Minister of Education (M.O. 032/2009) on

August 11, 2009 pursuant to

section 28(6) of the School Act.

1 The Private Schools Regulation (AR 190/2000) is

amended by this Regulation.

Section 1 is amended

(

a) in clause (

e) by striking out "Learning Grants

Regulation (AR 77/2003)" and substituting "Education

Grants Regulation (AR 120/2008)";

(

b) by adding the following after clause (e):

(e.1) "Level 1 accredited private school" means an accredited

private school that is not eligible to receive the First

Nation, Metis and Inuit Education Allocation;

(e.2) "Level 2 accredited private school" means an accredited

private school that is eligible to receive the First Nation,

Metis and Inuit Education Allocation;

Section 8 is amended by striking out "Learning Grants

Regulation (AR 77/2003)" and substituting "Education Grants

Regulation (AR 120/2008)".

Section 9(1) is amended by striking out "Learning Grants

Regulation (AR 77/2003)" and substituting "Education Grants

Regulation (AR 120/2008)".

Section 20 is amended

(

a) by adding "(AR 225/2006) after "Student Record

Regulation" wherever it occurs;

(

b) in subsection (2)

(

i) by striking out "to accredited private schools" and

substituting "to Level 1 accredited private schools";

(ii) in clause (

c) by striking out ", (4)";

(

b) by adding the following after subsection (2):

(2.1) The Student Record Regulation (AR 225/2006) applies

to Level 2 accredited private schools except for the following

sections:

(a)

section 2(1)(s);

(b)

section 3(3);

(c)

section 7(2)(

g) and (5);

(

d) section 9.

6 This Regulation comes into force on the coming into

force of

section 3 of the Public Health Amendment Act,

STUDENT RECORD AMENDMENT REGULATION

amended by this Regulation.

Section 7(4) is repealed.

Section 10 is repealed.
