B.C. Reg. 37/2013 , deposited February 1, 2013, pursuant to the CHILD CARE SUBSIDY ACT [section 13 (2) (

a) to (e)]. Order in Council 61/2013, approved and ordered February 1, 2013.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective February 1, 2013, the Child Care Subsidy Regulation, B.C. Reg. 74/97, is amended as set out in the attached Schedule.

Schedule

Section 7 (2) of the Child Care Subsidy Regulation, B.C. Reg. 74/97, is amended

(

a) in paragraph (c)

(

i) by striking out “ applicant has custody ” and substituting “ applicant has interim or temporary custody ”, and

(ii) by striking out “ 42.2 (4) (

c) or 49 (7) (b)” and substituting “ 42.2 (4) (c), 49 (7) (

b) or 54.01 (9) (b) ”, and

(

b) by adding the following paragraph:

(c.1) of whom the applicant has been permanently transferred custody under an order of the court under

section 54.01 (5) or 54.1 (3) of the Child, Family and Community Service Act , .

Section 8 (4) (

a) is repealed and the following substituted:

(

a) arranged or recommended by staff delegated under the Child, Family and Community Service Act , after staff have

(

i) offered support services or agreements to the child and family under

section 16 (2) (

a) of that Act, or

(ii) commenced an investigation under

section 16 (2) (

c) of that Act, or .
