Section 22.01 of the French version of the Provin- cial Court Act,

chapter P-21 of the Revised Statutes, 1973, is amended in the definition « Commission » by striking out “établie” and substituting “constituée”. 1 L’article 22.01 de la version française de la

Section 22.02 of the Act is amended 2 L’article 22.02 de la Loi est modifié (

a) in subsection (1) of the French version by striking out “Il est par les présentes établie une com- mission appelée” and substituting “Est constituée”;

a) the adequacy of judges’ remuneration, having regard to the cost of living or changes in real per cap- ita income;

b) the remuneration of other members of the judi- ciary in Canada as well as the factors which may jus- tify the existence of differences between the remuner- ation of judges and that of other members of the judiciary in Canada;

b) la rémunération versée aux autres membres de la magistrature du Canada ainsi que les facteurs qui peuvent justifier les différences qui existent entre la rémunération des juges et celle des autres membres de la magistrature du Canada; (

c) economic fairness, including the remuneration of other persons paid out of the Consolidated Fund;

d) the economic conditions of the Province; and

e) any other factors the Commission considers rele- vant to its review.

Section 22.03 of the Act is amended 4 L’article 22.03 de la Loi est modifié (

a) by repealing subsection (1);

7 Subsection 22.06(2) of the Act is amended by strik- ing out “section 22.05” and substituting “subsection 22.021(3)”. 7

TRANSITIONAL AND COMMENCEMENT DISPOSITIONS TRANSITOIRES ET ENTRÉE EN VIGUEUR Revocation of appointments Révocation de nominations 8(1) All appointments of members of the Judicial Re- muneration Commission that are in effect immediately before the commencement of this subsection are re- voked. 8(1) Sont révoquées toutes les nominations des mem- bres de la Commission sur la rémunération des juges qui étaient en vigueur immédiatement avant l’entrée en vigueur du présent paragraphe. 8(2) All contracts, agreements or orders relating to the allowance or expenses to be paid to members of the Judicial Remuneration Commission whose appoint- ments are revoked under subsection (1) are null and void. 8(2) Sont nuls et non avenus tous les contrats, les en- tentes ou les ordonnances portant sur les indemnités à verser ou les dépenses à rembourser aux membres de la Commission sur la rémunération des juges dont les no- minations ont été révoquées en vertu du paragra- phe (1). 8(3) Despite the provisions of any contract, agree- ment or order, no allowance or expenses shall be paid to a member of the Judicial Remuneration Commission whose appointment is revoked under subsection (1). 8(3) Par dérogation aux dispositions ou aux clauses de tout contrat, de toute entente ou de toute ordon- nance, aucune indemnité ne peut être versée et aucune dépense ne peut être remboursée aux membres de la Commission sur la rémunération des juges dont les no- minations ont été révoquées en vertu du paragra- phe (1). 8(4) No action, application or other proceeding lies or shall be instituted against the Minister of Justice or the Crown in right of the Province as a result of the revocation of appointments under subsection (1). 8(4) Bénéficient de l’immunité de poursuite engagée par voie d’action ou autre instance le ministre de la Justice et la Couronne du chef de la province du fait de la révocation des nominations à laquelle il est procédé en vertu du paragraphe (1). 8(5) For greater certainty, the term of office of a member of the Judicial Remuneration Commission that ends as a result of the revocation of his or her ap- pointment under subsection (1) shall be counted as a term for the purposes of subsection 22.02(6) of the Pro- vincial Court Act. 8(5) Il est entendu que le mandat d’un membre de la Commission sur la rémunération des juges qui prend fin du fait de la révocation de sa nomination à laquelle il est procédé en vertu du paragraphe (1) compte à
