OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works dated October 4, 2023, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act , and
Section 80 of
Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act , is pleased to: (
a) extinguish the right of the public to use those portions of the public highway, identified as Parcel "A", Lot 4, and Parcel "B", containing a combined area of 7,372.8 square metres (1.82 acres), more or less, located at or near Old Guysborough Road, Wyses Corner, Halifax County, more particularly described in
Schedule "A" and as shown on
Schedule "B" attached to a forming part of the Report and Recommendation; (
b) authorize the conveyance of the parcels of surplus land, Parcel "A", Lot 4 and Parcel "B", to Wyses Corner Developments Inc., a body corporate incorporated pursuant to the laws of the Province of Nova Scotia, for the consideration of $12,200.00 plus HST of $1,830.00 for a total purchase price of $14,030.00; (
c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands; and (
d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
