Section 5 of the Provincial Court Judges’ Pension Act,

chapter P-21.1 of the Acts of New Brunswick, 2000, is amended 1(1) L’article 5 de la

a) by repealing subsection (1) and substituting the following:

i) of the Income Tax Regulations under the Income Tax Act (Canada) on or before the thirty-first day of December preceding the date of the commencement of this subsection, and

Part III on retirement when combined with the total of the annual supplementary allowances and other annual sup- plementary payments that the judge would be entitled to be paid under

Part IV on that date equals 65% of his or her average salary, whether the recipient of the benefit is the judge, the spouse, common-law partner, child or estate of the judge or the legal representative of any of them. 5(4) La période maximale de service ouvrant droit à pension d’un juge dont il peut être tenue compte pour le calcul d’une prestation versée en vertu de la présente loi ou des règlements – que le bénéficiaire de la prestation soit le juge, son conjoint, son conjoint de fait, son enfant ou sa succession, ou le représentant légal de l’un quelconque d’entre eux – est celle qui se termine à la date à laquelle le montant total de la pension annuelle à laquelle le juge au- rait droit au versement à sa retraite en vertu de la

Section 18 of the Act is amended 1(2) L’article 18 de la Loi est modifié (

a) by adding after subsection (1) the following:

Section 37 of the Act is amended 1(3) L’article 37 de la Loi est modifié (

a) in subsection (3.1) by striking out “sixty-nine” and substituting “the age prescribed in subparagraph 8502(e)(

i) of the Income Tax Regulations under the Income Tax Act (Canada)”;

chapter P-21 of the Revised Statutes, 1973, is amended by striking out “sixty-nine” and substituting “the age prescribed in subparagraph 8502(e)(

i) of the Income Tax Regulations under the Income Tax Act (Canada)”. 3(1)

i) du Règlement de l’impôt sur le revenu pris en vertu de la Loi de l’impôt sur le revenu (Canada) ». 3(2) Subsection 15(10) of the Act is amended in the portion preceding paragraph (

a) by striking out “sixty- nine” and substituting “the age prescribed in subpara- graph 8502 (e)(
