On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the

Schedule of the Independent School Act , R.S.B.C. 1996, c. 216, is amended as set out in the attached Appendix 1, and

(

b) the Independent School Regulation, B.C. Reg. 262/89, is amended as set out in the attached Appendix 2.

Appendix 1

Section 2 of the

Schedule of the Independent School Act, R.S.B.C. 1996, c. 216, is amended

(

a) by renumbering the

section as

section 2 (1) ,

(

b) in subsection (1) by adding the following paragraphs:

(d.1) for the 2014/2015 school year, the enrollment in the independent school

(

i) is not fewer than 10 school age students on October 17, 2014, or

(ii) if fewer than 10 school age students on October 17, 2014, was not fewer than 10 school age students on September 30, 2013;

(d.2) for the 2015/2016 school year, the enrollment in the independent school

(

i) is not fewer than 10 school age students on September 30, 2015, or

(ii) if fewer than 10 school age students on September 30, 2015, was not fewer than 10 school age students on October 17, 2014; ,

(

c) in subsection (1) (

e) by striking out “ the enrollment in the independent school ” and substituting “ for the 2016/2017 school year and subsequent school years, the enrollment in the independent school ”, and

(

d) by adding the following subsection:

(2) Subsection (1) (d.1) and (d.2) is repealed on July 1, 2016.

Appendix 2

1 The Independent School Regulation, B.C. Reg. 262/89, is amended by adding the following section:

Special rules for 2014/2015 school year

(1) Despite

section 2, for the purposes of applying

section 2 (1) to the 2014/2015 school year,

(

a) the reference to “October 15 of the school year for which a grant is claimed” must be read as a reference to “November 30, 2014”, and

(

b) all references to “September 30 of that school year” must be read as references to “October 17, 2014”.

(2) Despite

section 3, for the purposes of applying

section 3 (4) and (5) to the 2014/2015 school year, the references to “September 30 of the school year” must be read as references to “October 17, 2014”.

(3) This

section is repealed on July 1, 2015.
