B.C. Reg. 225/2017 , deposited December 8, 2017, under the TENANCY STATUTES AMENDMENT ACT, 2017 [section 62], the MANUFACTURED HOME PARK TENANCY ACT [section 89] and the RESIDENTIAL TENANCY ACT [section 97]. Order in Council 492/2017, approved and ordered December 8, 2017.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective December 11, 2017,

(

a) sections 1, 3 to 6, 23, 25, 26, 28, 29, 31 to 33, 50 and 52 of the Tenancy Statutes Amendment Act, 2017 , S.B.C. 2017, c. 18, are brought into force,

(

b) the Manufactured Home Park Tenancy Regulation, B.C. Reg. 481/2003, is amended as set out in the attached Appendix 1, and

(

c) the Residential Tenancy Regulation, B.C. Reg. 477/2003, is amended as set out in the attached Appendix 2.

Appendix 1

1 Sections 33 (1) (

a) and 51 of the Manufactured Home Park Tenancy Regulation, B.C. Reg. 481/2003, are repealed.

Appendix 2

1 The Residential Tenancy Regulation, B.C. Reg. 477/2003, is amended by adding the following

section to

Part 2:

Fixed term tenancy – circumstances when tenant must vacate at end of term

13.1

(1) In this section, “close family member” has the same meaning as in

section 49 (1) of the Act.

(2) For the purposes of

section 97 (2) (a.1) of the Act [prescribing circumstances when landlord may include term requiring tenant to vacate] , the circumstances in which a landlord may include in a fixed term tenancy agreement a requirement that the tenant vacate a rental unit at the end of the term are that

(

a) the landlord is an individual, and

(

b) that landlord or a close family member of that landlord intends in good faith at the time of entering into the tenancy agreement to occupy the rental unit at the end of the term.

Section 23 (1) (

a) is repealed.

Section 7 (1) of the

Schedule is amended by striking out “ If this tenancy agreement is for a fixed length of 6 months or more, ” and substituting “ If this is a fixed term tenancy agreement and there are 6 months or more remaining in the term, ”.
